RECOMMENDED ORDER


A hearing was held in the above-captioned matter, after due notice to the parties, at Fort Lauderdale, Florida, on June 29, 1976, before the undersigned Hearing Officer.

Respondent's alleged violation of Sections 477.02(6), 477.15(8), and 477.27(1) & (2), Florida Statutes.


Respondent is charged with allowing Grace M. Mazzogatle to practice cosmetology in Respondent's salon without a license on January 7, 1976.


It was stipulated by the parties that Respondent's salon is out of business at the present time and that Respondent no longer holds a valid salon license.

Therefore, it was further stipulated by the parties that Petitioner lacks jurisdiction to take adverse action against a nonexistent license.


RECOMMENDATION


That the allegations against Respondent be dismissed.
