A copy of said Recommended Order is attached hereto and by reference incorporated herein. Respondent was present and represented by Charles Curtis, Esq. Petitioner was represented by Miriam S. Wilkinson, Esq. After a complete review of the record in this matter, including consideration of the exceptions filed by Respondent and the Petitioner's Response to said exceptions, the Board makes the following findings and conclusions: FINDINGS OF FACT The Board, having reviewed the Recommended Findings of Fact adopts and incorporates by reference the findings of fact of the Administrative Law Judge. Respondent's exceptions are REJECTED as unsupported by the record, for the reasons stated in Petitioner's Response to the exceptions. CONCLUSIONS OF LAW Having reviewed the Recommended Conclusions of Law, the Board adopts the Administrative Law Judge’s conclusions of law. There is competent and substantial evidence to support the Board's findings and conclusions. THEREFORE, IT IS HEREBY ORDERED AND ADJUDGED: That the penalty recommended by the Administrative Law Judge is adopted as the penalty imposed by the Board, with the following clarification. Since continuing education courses are not provided in tenths of an hour, the Respondent shall compiete 5 hours of continuing education, 3 hours in cystotomy and 2 hours in oresthrostomy. The fine shall be as stated in the Recommended Order, $499. Pursuant to Section 120.59, Florida Statutes, the Parties are hereby notified that they may appeal this Order by filing one copy of a Notice of Appeal with the Clerk of the Department of Business and Professional Regulation, Northwood Centre, 1940 N. Monroe Street, Tallahassee, Florida 32399-0792, and by filing the filing fee and one copy of the Notice of Appeal with the District Court of Appeal within thirty (30) days of the date this Order is filed. This Order shall become effective upon filing with the Clerk of the Department of Business and Professional Regulation. DONE AND ORDERED this day of losermlaan, 996. __ DR ROBERT E.
