CONSENT ORDER

THIS CAUSE came on for consideration upon the Administrative Complaint issued by the Department of Agriculture and Consumer Services ("Department") on February 12, 1998, and the Commissioner of Agriculture being fully advised in the premises, hereby finds as follows:

1. The Commissioner of Agriculture, as head of the Department, has jurisdiction over the subject matter and the parties thereto.

2. The Department and Respondents have resolved the issues in this case.

3. The entry of this Consent Order and compliance therewith by Respondents shall conclude this administrative proceeding.

   IT IS ORDERED AND ADJUDGED as follows:

   1. The Respondents shall forward to the Department an administrative fine in the amount of FIVE HUNDRED ($500.00) DOLLARS. The Department acknowledges that full payment of the administrative fine has been received as of the date of this Consent Order.

   2. The failure of the Respondent to comply with the Florida Food Safety Act may result in further action by the Department against the Respondent as authorized by law.

   3. Except as contained and described in the Joint Settlement Stipulation for Consent Order, each party shall bear its own costs and attorneys' fees.
