This cause came before me for the purpose of issuing a final agency order, it
' appearing from the Settlement Agreement, attached and incorporated herein, that there
are no remaining disputed issues of fact.

FINDINGS OF FACT
1. On November 13 , 2001, a Stipulation and Settlement
Agreement between the parties was executed which dismissed the Petitioners case against
the Agency.
2. There are no remaining disputed issues of fact or law.
CONCLUSIONS OF LAW
The Agency has jurisdiction over the parties and subject matter pursuant to
Section 120.57, Fla. Stat. (2000). The parties are directed to comply with the terms of the
Stipulation, Settlement and Dismissal. The petition is dismissed and the file is closed this

1. The Respondent, STATE OF FLORIDA, AGENCY FOR HEALTH CARE
ADMINISTRATION (“AHCA”) shall revise its audits of Petitioner’s Medicaid Cost Reports for
the fiscal year ended January 31, 1998 (Woodbridge), and fiscal yeat ended January 31, 1997 and
January 31, 1998 (Crystal Springs), in accordance with the attached letter adopted and
incorporated herein by reference, dated April 23, 2001 from AHCA Audit Analyst Steven
Diaczyk to Ms. Carol Disbro of IHS.
2. Based upon this agreement, the Petitioner agrees to dismiss its Petitions in this
case with prejudice, ;
3. The Agency agrees to amend its proof of claim in the bankruptcy proceedings of
Integrated Health Services and its subsidiaries, filed in the U.S. Bankruptcy court for the District
of Delaware, Case No. 00-389, to reflect the changes afforded by this Settlement Agreement. .
4. The AHCA agrees to adopt and incorporate this Agreement in its Final Order.
5, Each Party agrees to bear its own costa and fees associated with this action.
6. The signatories represent and warrant that they are vested with the authority to
execute this settlement agreement on behalf of their respective principles and to fully bind such
principals, their successors and assigns to its terms. .
