Based upon this agreement, the Petitioner agrees to dismiss its Petitions in this case with prejudice, ; 3. The Agency agrees to amend its proof of claim in the bankruptcy proceedings of Integrated Health Services and its subsidiaries, filed in the U.S. Bankruptcy court for the District of Delaware, Case No. 00-389, to reflect the changes afforded by this Settlement Agreement. . 4.
