Respondent. / MINISTRATIVE COMPLAINT COMES NOW, the Petitioner, Department of Health, hereinafter referred to as "Petitioner", and files this Administrative Complaint before the Board of Chiropractic Medicine against Brian William Johnson, D.C., hereinafter referred to as Respondent," and alleges: 1. Petitioner is the state agency charged with regulating the practice of podiatric medicine pursuant to Section 20.43(3), Florida Statutes, chapter 455, Florida Statutes; and Chapter 460, Florida Statutes. , 2. Pursuant to the authority of Section 20.43(3)(g), Florida Statutes, the Petitioner has contracted with the Agency for Health Care Administration, hereinafter referred to as the “Agency," to provide consumer complaint, investigative, and . prosecutorial served required by the Division of Medical Quality Assurance, councils, or boards, as appropriate, including the issuance of emergency orders of suspension or restriction. we, 3. Respondent has been at a!l times pertinent hereto, a duly licensed chiropractic physician pursuant to Chapter 460, Florida Statutes, having been issued license number CH 0006130. 4. Respondent's last known address if 7436 Jager Court, Cincinnati, Ohio Sa edie 45230. ee, 5. On or about June 20, 1997, the State of Ohio, State Board of Chiropractic Examiners entered an order suspending the Respondent's Ohio license to practice chiropractic medicine for the duration of one (1) year. 6. Based on the foregoing, the Respondent's license to practice chiropractic medicine in the State of Florida is subject to discipline pursuant to Section 460.413(1)(b), Florida Statutes, for having a license to practice chiropractic suspended by the licensing authority of another state. | | WHEREFORE, Petitioner respectfully requests the Board of Chiropractic Medicine enter an Order imposing one or more of the following penalties: imposition of an administrative fine not to exceed $1,000 for each offense, issuance of a reprimand, placement of the Respondent ¢ on probation, suspension of the Respondent's license to practice, revocation of the-Respondent's license and/or any other relief that the Board deems appropriate.
