DANFORTH, JR., Petitioner, AHCA Case Number: 99-58129 Respondent. / ADMINISTRATIVE COMPLAINT Petitioner, DEPARTMENT OF HEALTH, hereinafter referred to as “Petitioner,” files this Administrative Complaint before the Board of Orthotists and Prosthetists, against MICHAEL B. DANFORTH, JR., hereinafter referred to as “Respondent,” and alleges: 1. Effective July 1, 1997, Petitioner is the state agency charged with regulating the practice of Orthotists and Prosthetists pursuant to Section 20.43, Florida Statutes, Chapter 456, Florida Statutes (formerly Chapter 455, Part II; see Chapter 2000-160, Laws of Florida), and Chapter 468, Part XIV, Florida Statutes. Pursuant to Section 20.43 (3)(g), Florida Statutes, the Department has contracted with the Agency for Health Care Administration to provide consumer complaint, investigative, and prosecutorial services required by the Division of Medical Quality Assurance, councils, or boards, as appropriate. Respondent is a licensed Prosthetist-Orthotist in the State of Florida, having been issued license number 0000103. Respondent’s address of record is 1170 West Wellington Drive, Deltona, Florida 32775. On or about February 25, 1998, the Respondent submitted an application for licensure to the Board of Orthotists and Prosthetists. The Respondent was seeking licensure as a Prosthetist-Orthotist under the requirements of the grandfathering statute, Section 468.805, Florida Statutes. 01-OS95 PL 6. To qualify for a license under this statute, the Respondent was required to have practiced prosthetics and orthotics in the State of Florida for at least five years between the period of July 1, 1990 until March 1, 1998. 7. The Respondent included two employment verification forms with his application. These forms stated his place and dates of employment and a brief description of his job responsibilities. 8. On April 14, 1999, a Notice of Intent to Deny the Respondent’s application for licensure as a prosthetist-orthotist was filed with the Clerk of the Department of Health. 9. In response to this Notice, the Respondent requested a hearing before the Board of Orthotists and Prosthetists and appeared before the Board on July 9, 1999. 10. In response to his testimony at this hearing, the Respondent's application for licensure was approved. — — . Investigation revealed that the Respondent worked primarily as a technician, providing a limited amount of patient care. 12. During his testimony before the Board, the Respondent asserted that he had sufficient patient care experience to satisfy the five year requirement and the Board relied on the Respondent’s assertion and granted the licensure. Based on the foregoing, the Respondent is subject to discipline for violation of Section 455.624(h), Florida Statutes (presently Section 456.072(h), Florida Statutes) by attempting to obtain, obtaining, or renewing a license through procure a license by fraudulent misrepresentation, bribery, or error of the department or board. Respondent’s license on probation for a period of time and subject to terms and/or conditions imposed by the Board; and/or any other relief that the Board deems aporonriate. I
