The Agency notified the Petitioner by a letter dated November 22, 2000, of its intent to change to conditional effective November 13, 2000, the license rating of the Petitioner’s facility, Sunbridge Care & Rehabilitation for St. ‘Cloud ("Sunbridge"), and advised the Petitioner of its right to request an administrative hearin Based on a subsequent po cogent inspection, SS nbridge | Was rated as Standard effective January 11, 2001. 2. Petitioner was served a copy of the letter and requested a Formal Hearing via 4 its petitions dated December 21, 2000. Based ona Motion to Dismiss, the Administrative Law gudge (ALJ) closed his file “and referred the | matter back to the Agency for 1 ay _ A PARTY WHO IS entry of a Final Order. The “Order Closing File” filed March 6, 2001, is incorporated by reference. 3. Petitioner is licensed to operate a “nursing home at 1301 Kansas Avenue, - st. “Cloud, “Plorida 34769, pursuant to Chapter 400, Part II, Florida Statutes, and Chapter 59A-4, Florida Administrative Code. 4. The Petitioner has abandoned its “Petition for Formal Administrative Hearing” by its Motion to Dismiss: dated February 27, 2001, which is incorporated by reference. CONCLUSIONS OF LAW 5. The Agency for Health Care Administration has jurisdiction over Petitioner by virtue of the provisions of Chapter 400, Part II, Florida Statutes. 6. The Agency has authority to change the licensure rating pursuant to Section 400.23(8), Florida. Statutes. , Based on the foregoing, Sunbridge is rated as conditional from November 13, 2000 to January 11, 2001. This proceeding is. closed.
