M hs gy ADMINISTRATION, OM Weis Or TI Le, Petitioner, AINE “e vs. AHCA NO: 09-01-0001 HHA OW;240 CENTURY PROFESSIONAL RECRUITMENT, INC., d/b/a CENTURY HEALTH SERVICES, Respondent. / ADMINISTRATIVE COMPLAINT YOU ARE HEREBY NOTIFIED that after twenty ‘one (21) days from the receipt of this Complaint the Agency for Health Care Administration (hereinafter referred to as "Petitioner") intends to impose an administrative fine in the amount of One Thousand Five Hundred ($1,500) upon Century Professional Recruitment, Inc., d/b/a Century Health Services (hereinafter referred to as "Respondent"). As grounds for this ‘administrative fine the Petitioner alleges as follows: ; 1. Petitioner has jurisdiction over Respondent by virtue of the provisions of Chapter 400, Part IV, (F.S.) . 2. Respondent is licensed to operate at 115 Boca Raton Road, Boca Raton, Florida 33432, as a Home Health Agency in compliance with Chapter 400, Part IV, (F.S.), and Rule 59A-8, Florida Administrative Code (F.A.C.). 3. On May 15, June 14 and August 7, 2000 during revisits conducted by personnel from the Agency for Health Care Administration revealed that Respondent was operating a home health agency and no one was available at the office on those dates. (2) | On 5/11/00 the surveyor arrived at the Boca Raton location to conduct a revisit to the 2/11/00 survey, between 9:15 - 9:45 am. The office was closed and there was no staff person present to answer the door. The surveyor called the Deerfield Beach office. The administrator was not in the office at that time. The surveyor left her cellular phone number with a staff person so that the administrator could call her. The surveyor waited 45 minutes and did not receive a response from the administrator. The revisit survey was terminated and the surveyor left the location. Field Office staff attempted to call the Boca Raton office on 5/16/00. The phone rang but there was no answer. The Deerfield Beach office was then called and spoke with the administrator. She stated that she was doing a home visit at the time she was beeped by her office and it took her approximately one hour and 15 minutes to get to the Boca Raton office but the surveyor had already left the location. She stated she did not have a staff person at the office at all times because they had only 3 clients in Palm Beach County. (b) On 6/14/00 the surveyor arrived at the agency at 12:45 p.m.. All doors to the building were locked and no one answered the bell (which was loud enough to be audible outside the building). The surveyor remained at the location until 2:30 p.m. The doors remained locked and the bell went unanswered. At approximately 2:45 p.m., the surveyor called the telephone number listed for the agency location in the local directory. There was no answer, no answer machine, and no answer service. The surveyor then called the telephone number listed for the corporate office, which is located in another county. The call was answered on the first ring and when the surveyor asked for the hours of operation of the Boca Raton office, was informed “Monday through Friday from 9 to 5”. The surveyor also verified the name of the administrator, but was informed that the office did not know where she was, however they would beep her. At 3:00 p.m. the surveyor again called the Boca location. Again there was no answer, machine or service. The surveyor reached the administrator by phone at approximately 3:15 p.m. The administrator stated that she was at the Boca location and would be there until 5:00 p.m. i t i i i i 5 i 3 The administrator stated that there is no one in the office and the number in the phone book is the “back line”; the number from the previous location in Boynton Beach is the main number, even through it is not listed in the telephone directory. (c) During an unannounced revisit to the agency at 10:45 on 8/07/00, the surveyor found that the front door of the building was locked and no one answered the doorbell (which was loud enough to be audible outside the building). .The surveyor walked around to the back of the building to check the agency front door. The door was locked and no one answered the repeated knocks on the door. The surveyor remained at ’ the agency door for approximately one-half hour. No one from the agency was available on the premises during the entire time the surveyor was attempting to conduct an unannounced revisit. This is in violation of rule 59A-8.003(9), Florida Administrative Code. Repeated Class Ill deficiency. $1,500 fine. 4. The above referenced violations constitute grounds to levy this administrative fine pursuant to Section 400.474, (F.S.), in that the Respondent has violated the minimum standards, rules and regulations promulgated by the Agency under Chapter 400, Part IV, (F.S.) 5. Respondent is notified that it has a right to request an administrative hearing pursuant to Section 120.569, (F.S.); to be represented by counsel (at its expense); to take testimony, to call and cross-examine witnesses, to have subpoenas and/or subpoenas duces tecum issued, and to present written evidence or argument if it requests a hearing. In order to obtain a formal proceeding, your request for an administrative hearing must conform to the requirements in Rule 28-106.201, (F.A.C.), and must state which issues of material fact you dispute. Failure to dispute material issues of fact in your request for a hearing may be treated by the Agency as an election by you of an informal proceeding under Section 120.57(2), (F.S.) ELECTION OF RIGHTS FORM ATTACHED 6. RESPONDENT IS FURTHER NOTIFIED THAT FAILURE TO REQUEST A HEARING WITHIN TWENTY ONE (21) DAYS OF RECEIPT OF THIS COMPLAINT WILL RESULT IN AN ADMISSION OF THE FACTS ALLEGED IN THE COMPLAINT AND THE ENTRY OF A FINAL ORDER BY THE AGENCY.
