ADMINISTRATIVE COMPLAINT
COMES NOW, the Petitioner, Department of Health, hereinafter referred to as “Petitioner,” and
files this Administrative Complaint before the Board of Clinical Social Work, Marriage and Family and
Mental Health Counseling against ROBIN REISERT, hereinafter referred to as “Respondent,” and
alleges: .
1. Effective July 1, 1997, Petitioner is the state agency charged with regulating the practice of
clinical social work pursuant to Section 20.43, Florida Statutes, Chapter 456, Florida Statutes
(formerly Chapter 455, Part II; see Chapter 2000-160, Laws of Florida), and Chapter 491,
Florida Statutes. Pursuant to Section 20.43 (3)(g), Florida Statutes, the Department has
contracted with the Agency for Health Care Administration to provide consumer complaint,
investigative, and prosecutorial services required by the Division of Medical Quality
Assurance, councils, or boards, as appropriate.
2. Respondent is and has been at all times material hereto, a licensed Clinical Social Worker,
licensed in the State of Florida, having been issued license number 3475.
3. Respondent’s last known address is 539 Versailles Drive, Maitland, Florida 32751.
- 4, Onor about November 4, 1999, the Respondent began counseling with the minor children of
the Complainant (the initials of both children are CO).
5. The Respondent stated that she does not maintain notes of her therapy sessions. The rules
governing the practice of clinical social work and the standards of the clinical social work
profession require that a licensee maintain and record notes of the therapeutic sessions with
their clients and/or patients.
6. Inasworn statement of the Respondent taken on May 31, 2000, the Respondent identified
herself as having a license in “clinical psychiatric social work” that was issued by the State of
Florida. The Respondent also stated that her license was “national, too.” Misrepresenting
one’s licensure violates the rules and statutes governing the practice of clinical social work.
Based on the foregoing, the Respondent is subject to discipline for violation of Section 491.009
(2)(q), Florida Statutes, through a violation of section 491.0148, Florida Statutes and 64B4-9.001(1) and
(2), Florida Administrative Code, by failing to maintain records; section 491.009(2)(1), Florida Statutes,
by making misleading, deceptive, untrue or fraudulent representations in the practice of clinical social
work; and 491.009(2)(s), Florida Statutes, by failing to meet minimum standards of performance in
professional activities when measured against generally prevailing peer performance.
WHEREFORE, Petitioner respectfully requests the Board of Clinical Social Work, Marriage and
Family Therapy, and Mental Health Counseling to enter an order imposing one or more of the following
penalties: revocation or suspension of Respondent’s license; restriction of Respondent's practice;
imposition of an administrative fine; issuance of a reprimand; placement of the Respondent’s license on
. probation for a period of time and subject to terms and/or conditions, and/or any other relief which the
Board deems appropriate.
