Pursuant to the authority of - Section 20.43 (3)(g), Florida Statutes, the Petitioner has contracted with the Agency for : = Health Care Administration, hereinafter “Agency,” to provide consumer complaint, investigative, and prosecutorial services required by the Division of Medical Quality , Assurance, councils or boards, a as appropriate Respondent is, at all times material hereto a duly licensed massage . therapist, having be n issued license number MA 0008850. y Ue. 3. Respondent’s last known address i is 611 Woolbright Road, Boynton Beach, Florida 33435, 4. Onor about November 4, 1997 Respondent offered to masturbate a client. 5. The client was an undercover detective. | 6. The detective arrested the Respondent for prostitution. 7. The Respondent was charged with a criminal violation of Section 796.07 Florida Statutes in Palm Beach County, Florida County Court Case No. 97-026081 — MMA 04. 8. On May 7, 1998 the Respondent entered a guilty plea to the offense of soliciting prostitution (Florida Statutes 796.07) and adjudication was withheld, COUNT I 9. Petitioner repeats and re-alleges the allegations of paragraphs | through 8 _ . above. 10. Based on the foregoing, the Respondent has violated Section 480.046 (1) (c) Florida Statutes by being convicted or found guilty regardless of adjudication, of a crime in any jurisdiction which directly relates to the practice of massage or to the ability “to practice massage. i 4 ww wo: WHEREFORE, Petitioner respectfully requests the Board of Massage Therapy enter an order i imposing one or more of the following penalties: 1 ‘evocation or suspension of the Respondent’ license, restriction of the Respondent’ $ practice, imposition ofa an administrative fine, issuance of a teprimand, placement of the Respondent on probation, assess costs of investigation and prosecution and/or any other relief that the Board deems - appropriate.
