KREUTCHIC, O'/ OF Respondent. . : / ADMINISTRATIVE COMPLAINT COMES NOW, the Petitioner, Department of Health, hereinafter referred to as “Petitioner,” and files this Administrative Complaint before the Board of Speech Language Pathology and Audiology against DIANA C. KREUTCHIC, hereinafter referred to as “Respondent,” and alleges: 1. Effective July 1, 1997, Petitioner is the state agency charged with regulating the practice of audiology pursuant to Section 20.43, Florida Statutes, Chapter 456, Florida Statutes, (formerly Chapter 455, Part II; see Chapter 2000-160, Laws of Florida), and Chapter 468, Florida Statutes. Pursuant to Section 20.43(3)(g), Florida Statutes, the Department has contracted with the Agency for Health Care Administration to provide consumer complaint, investigative, and prosecutorial services required by the Division of Medical Quality Assurance, councils, or boards, as appropriate. : . 2. Respondent is, and has been at all times material hereto, a licensed Audiologist in the State of Florida, having been issued license number AY 832. 3. Respondent’s present address of record is 18744 Northwest 100" Avenue Road, Micanopy, Florida 32667. 4. Inthe August 2000 edition of the Lady Lake Magazine, the Respondent placed an advertisement that advertised a free hearing consultation, a summer special, and advised readers to ask how they could qualify for “free” hearing aids. 5. The advertisement did not tell readers that the “free” hearing consultation was an offer being made in conjunction with an investment firm promoting bonus and indexed annuities. 6. The failure'to fully disclose that the hearing aid consultation was being made in conjunction with an investment firm constitutes false and misleading advertising. 7. Inthe August 2000 advertisement, the Respondent states that she is a fellow of the American Academy of Audiology; however, her Academy membership expired in December, 1997. Based on the foregoing, the Respondent is subject to discipline for violation of Section 468.1295(1)(e), Florida Statutes, by advertising goods or services in a manner which is fraudulent, false, deceptive, or misleading in form or content. WHEREFORE, the Petitioner respectfully requests the Board of Speech Language Pathology and Audiology to enter an Order imposing one or more of the following penalties: revocation or suspension of license; imposition of an administrative fine; issuance of a reprimand; placement of the Respondent on probation; and/or any other relief that the Board deems appropriate.
