Respondent. / ee ADMINISTRATIVE COMPLAINT Petitioner, Charlie Crist, as Commissioner of Education, files this Administrative Complaint against William Husfelt, Il. The Petitioner seeks the appropriate disciplinary sanction of the Respondent’s educator’s certificate pursuant to Sections 231.262 and 231.2615, Florida Statutes, and pursuant to Rule 6B-1.006, Florida Administrative Code, Principles of Professional Conduct for the Education Profession in Florida, said sanctions specifically set forth in Sections 231.262(6) and 231.2615(1), Florida Statutes. The Petitioner alleges: JURISDICTION 1. The Respondent holds Florida educator’s certificate 480349, covering the areas of English, school principal, social science and middle grades, which is valid through June 30, 2005. 2. At all times pertinent hereto, the Respondent was employed as a Principal at A.C.Mosley Senior High School, in the Bay County School District. MATERIAL ALLEGATIONS . | 3. During the 1997-1998 school year, Respondent acted inappropriately in his position as principal when he used his authority to harass, intimidate and impede Releah Lent, the former faculty advisor of the student newspaper “Making Waves”. Respondent arranged that Ms. Lent be moved to a smaller room in an inconvenient location, and he assigned her to teach ‘at risk’ students even though she had not received any training to teach such a class and other teachers had. received this training. Respondent refused to consider Ms. Lent on several occasions for supplemental employment positions despite Ms Lent’s obvious qualification for the supplements. P William Husfelt, III Administrative Complaint ‘20f3 In this and other ways, Respondent used his position as principal to carry out a campaign of intimidation against Ms. Lent. He thus failed in his duty to treat each teacher at his school in a fair and professional manner, and to promote the education of the students under his charge. STATUTORY VIOLATIONS COUNT 1: The allegations of misconduct set forth herein are in violation of Section 231.2615(1)(f), Florida Statutes, in that Respondent, upon investigation, has been found guilty of personal conduct which seriously reduces his effectiveness as an employee of the school board. COUNT 2: The allegations of misconduct set forth herein are in violation of Section 231.2615(1)(i), Florida Statutes, in that Respondent has violated the Principles of Professional . Conduct for the Education Profession in Florida prescribed by State Board of Education. RULE VIOLATIONS COUNT 3: The allegations of misconduct set forth herein are in violation of Rule 6B- 1,006(3)(a), Florida Administrative Code, in that Respondent has failed to make reasonable effort to protect the student from conditions harmful to learning and/or to the student’s mental health and/or physical safety. COUNT 4: The allegations of misconduct set forth herein are in violation of Rule 6B- 1.006(3)(c), Florida Administrative Code, in that Respondent has unreasonably denied a student access to diverse points of view. COUNT 5: The allegations of misconduct set forth herein are in violation of Rule 6B- 1.006(4)(a), Florida Administrative Code, in that Respondent has failed to take -reasonable precautions to distinguish between personal views and those of any educational institution or organization with which the individual is affiliated. : COUNT 6: The allegations of misconduct set forth herein are in violation of Rule 6B- 1.006(5)(b), Florida Administrative Code, in that Respondent has denied to a colleague professional benefits or advantages or participation in any professional organization on the basis of race, color, religion, sex, age, national or ethnic origin, political beliefs, marital status, handicapping condition if otherwise qualified, or social and family backgro William Husfelt, 11. Administrative Complaint 3 of 3 COUNT 7: The allegations of misconduct set forth herein are in violation of Rule 6B- 1.006(5)(d), Florida Administrative Code, in that Respondent has engaged in harassment or discriminatory conduct which unreasonably interfered with an individual’s performance of professional or work responsibilities or with the orderly processes of education or which created a hostile, intimidating, abusive, offensive, or oppressive environment; and further, failed to make reasonable effort to assure that each individual was protected from such harassment or discrimination. COUNT 8: The allegations of misconduct set forth herein are in violation of Rule 6B- 1.006(5)(f), Florida Administrative Code, in that Respondent has used coercive means or promised special treatment to influence professional judgment of colleagues. WHEREFORE, the Petitioner recommends that the Education Practices Commission impose an appropriate penalty pursuant to the authority provided in Sections 231.262(6) and 231.2615(1), Florida Statutes, which penalty may include a reprimand, probation, restriction of the authorized scope of practice, administrative fine, suspension of the teaching certificate not to exceed three years, permanent revocation of the teaching certificate, or combination thereof, for the reasons set forth herein, and in accordance with the Explanation and Election of Rights forms - which are attached hereto and made a part hereof by reference.
