MINISTRATIVE COMPLAINT Petitioner, DEPARTMENT OF BUSINESS AND PROFESSIONAL REGULATION, ("Petitioner"), files this Administrative Complaint before the Construction Industry Licensing Board, against PAUL MARCHESE. JR., ("Respondent"), and says: 1. Petitioner is the state agency charged with regulating the practice of contracting pursuant to Section 20.165, Florida Statutes, and Chapters 455 and 489, Florida Statutes. 2: Respondent is, and has been at all times material hereto, | a certified residential contractor in the State of Florida, having been issued license number CR €057007. 3. Respondent's last known address i is 1790 ‘Apex Road, Sarasota, Florida 34240, 4. At all times material hereto, Respondent was the qualifying agent for R & J Construction of Sarasota, Inc. Cee ERT parse pe cee ee licensee, revoke, sus; or all penalties delineated within Section 455. 227(2), Florida Statutes, and/or a any other relief that 3. Section 489.1195(1)(a), Florida Statutes (1999), provides that all primary qualifying agents for a business organization are jointly and equally responsible for supervision of all operations of the business organization; for all field work at all sites; and for financial matters, both for the organization in general and for each specific job. 6. During the year 1997, Respondent contracted with Michael and Tessy Alonso (hereinafter "the Alonsos"), whereby Respondent was to perform repair work to a fire-damaged home located at 2260 Melody Road, Englewood, Florida 34203, 7, On or about July 21, 2000, the Sarasota County General Contractors Licensing and Examining Board found Respondent in violation of Sarasota County Ordinances and suspended Respondent's permitting privileges in Sarasota County for ninety days, except for work at the Alonsos' home. 8. Based on the foregoing, Respondent violated Section 489. 1291), Florida Statutes ' (1999), by being disciplined by any municipality or county for any act or violation of this part.
