ADMINISTRATIVE COMPLAINT Petitioner, Tom Gallagher, as Commissioner of Education, files this Administrative Complaint against Michael Chandler. The Petitioner seeks the appropriate disciplinary sanction of the Respondent’s educator’s certificate pursuant to Sections 231.262 and 23 1.28, Florida Statutes, and pursuant to Rule 6B-1.006, Florida Adrninistrative Code, Principles of Professional Conduct for the Education Profession in Florida, said sanctions specifically set forth in Sections 231.262(6) and 231.28(1), Florida Statutes. £ The Petitioner alleges: , a a ee "JURISDICTION 1, The Respondent holds Florida Educator’s Certificate 5 16812, covering theareasof . : - Political Science, Social Science and Administration and Supervision, which is valid through June ~ 30, 2001 Peaetinniers : 2. Tee During the months of July and August during September 1998, Respondent was: aware of an incident in which a coach at the First Coast High School fondled and attempted to have sex with a minor female student L.C. Respondent failed to report the incident as required by school os board policy, and his duty as an administrator of the school. On or about May 7, 1999, Respondent ens received a letter of reprimand and was suspended to ten days without pay and had his contract reduced to a probationary status. RULE VIOLATIONS COUNT 2: The allegations of misconduct set forth herein are in violation of Rule 6B- 1.006(3)(a), Florida Administrative Code, in that Respondent has failed to make reasonable effort to protect the student from conditions harmful to learning and/or to the student’s mental health and/or physical safety. secant COUNT 3: The allegations of misconduct set forth herein are in violation of Rule 6B- 1.006(3)(e), Florida Administrative Code, in that Respondent has intentionally exposed a student to unnecessary embarrassment or disparagement. ; COUNT 4: The allegations of misconduct set forth herein are in violation of Rule 6B- 1.006(5)(a), Florida Administrative Code, in that Respondent has failed to maintain honesty in all professional dealings.
