Petitioner is the state agency charged with regulating the practice of contracting pursuant to Section 20, 165, Fi lorida Statutes, and Chapters 455 and 489, Florida Statutes. 2, Respondent i is, and has been at all times material hereto, a Certified General Contractor in the State of Florida, having been issued license number CG €048829, 3, Respondent's last known address is 4477 Marshall Street, Orlando, Florida, 32811. ) 4. On or about March 19, 2000, Joseph DeLeon (hereinafter “DeLeon”, doing : business as King Construction, contracted with Bill and Joy Blankenship (hereinafter “the ‘ Blankenships”), to construct an addition at their home at 179 Aunt Polly Court, Orlando, Florida. weer oe ve een Shc: SIAM BSB . 5. The contract price was $9,900.00 and DeLeon was paid approximately $8,400.00. 6. DeLeon paid his partner, Roosevelt Williams (hereinafter “Williams”), $3,800.00 to assist him with the project and to obtain the permit. . 7. Williams paid Respondent $350.00 to obtain the permit, and Respondent did pull the permit 8. Res pondent was not involved in any negotiations with the Blankenships, did not - receive any money from the Blankenships, and neither Roosevelt nor Williams were employees _ of Respondent 9. . All monies were paid by the Blankenships directly to DeLeon, 10, After DeLeon ceased work on the Project, the Blankenships contacted Respondent, who attempted to finish the jb, but was subsequently terminated. This was the first contact Respondent had with the Blankenships. . UL. Williams accompanied Respondent to the Blankenship’s home on several occasions while Respondent was attempting to finish the addition. 12. At no time material hereto was Deleon or Williams Yicensed asa contractor, nor “was King Construction licensed as a qualified business. 13. Based on the © foregoing, t the Respondent violated Section 489. 12901)(¢), Florida Statutes, by performing a any é act which a assists a person 0 or rent in n engaging in the prohibited ; uncertified and unregistered practice of contracting, if the certificateholder or registrant knows or "has reasonable grounds to know that the person or entity was uncertified and unregistered. WHEREFORE, Petitioner respectfully requests the Construction Industry Licensing Board enter an Order imposing one or more of the following penalties: place on probation, reprimand the licensee, revoke, suspend, deny the issuance or renewal of the certificate or 2 registration, require financial restitution to a consumer, impose an administrative fine not to exceed $5,000 per violation, require continuing education, assess costs associated with investigation and prosecution, impose any or all penalties delineated within Section 455.227(2), Florida Statutes, and/or any other relief that the Board is authorized to impose pursuant to " Chapters 489, 455, Florida Statutes, and/or the rules promulgated thereunder. signed this JBC day of Que woot _C Nas Hee, Qe F | L E D By: Robert A.
