Respondent. / ADMINISTRATIVE COMPLAINT COMES NOW, Petitioner, DEPARTMENT OF HEALTH, by and through its undersigned counsel and files this administrative complaint before the Board of Nursing against the Respondent, TERRY LEE SCHMITTENDORF, R.N., and in support thereof alleges: 1. Petitioner is the state agency charged with regulating the practice of nursing pursuant to Chapters 20, 456, and 464, Florida Statutes. 2. . Pursuant to the authority of Section 20. 43(8)(9), Florida Statutes, ‘the Petitioner has contracted with the Agency for Health Care Administration to “= _ | provide consumer complaint, investigative and prosecutorial services required by the. Division of Medical Quality Assurance, councils or boards, : as appropriate, including the issuance of emergency orders of suspension or restriction. 3. Respondent's last known address is 3137 SE 27" Street, Gainesville, Florida, 32641. 5. On or about February 7, 2000, Respondent was working at Shands ~ Alachua General Hospital, in Gainesville, Florida. Respondent is alleged to have administered two Percocet at 2045 hours to Patient R.L. The Patient Admission Assessment form, the medical administration record, and the admission form dated 2/2/2000 state that Patient R.L. was evaluated as havingt an allergy to codeine. While employed at Alachua General Hospital, located at 801 SW 2™ Avenue, in Gainesville, Florida, as a licensed Registered Nurse, Respondent was alleged to have administered two Percocet at 2045 hours to ‘Patient RL. on February 7, 2000. The appropriate entries were made in the patient's chart to show that R.L. was allergic to codeine. Respondent failed to review those records prior to administering Percocet t he foregoing, Respondent is subject to discipline © Bei Eee oo rn nena naa te ASS ARR fe oO WHEREFORE, Petitioner respectfully request that the Board of Nursing enter an Order imposing one or more of the following penalties: Revocation or suspension of Respondent's license, imposition of an administrative fine, issuance of a reprimand, placement of the Respondent on probation, cosis, and/or any other relief that the Board deems appropriate.
