a fey STATE OF FLORIDA DEPARTMENT OF HEALTH DEPARTMENT OF HEALTH Petitioner, vs. Case No. 2000-15917 GORDON GYOR, R-Ph., Respondent. / ADMINISTRATIVE COMPLAINT Department of Health, hereinafter referred to as “Petitioner,” files this Administrative Complaint before the Board of Pharmacy against GORDON GYOR, R.Ph., hereinafter referred to as “Respondent,” and alleges: 1. Petitioner is the state agency charged with regulating the practice of Pharmacy pursuant to Section 20.43, Chapter 456 (formally Chapter 455, Part II; see Chapter 2000-160, Laws of Florida), and Chapter 465, Florida Statutes. Pursuant to the authority of Section 20.43(3)(g), Florida Statutes, Petitioner has contracted with the Agency for Health Care Administration to provide consumer complaint, investigative and — prosecutorial services required by the Division of Medical Quality Assurance, councils, or boards. 2. Respondent is, and has been at all time material hereto, a licensed pharmacist in the State of Florida, having been issued license number PS 11403. Respondent’s last known address is 6045 Vista Linda Lane, Boca Raton, Florida 33433. y 3. On or about October 17, 2000, the Respondent was a licensed pharmacist employed at PET MED EXPRESS located in, Boca Raton, Florida. This is an on-line _ company providing prescription services. _ 4. Respondent, while employed at the aforementioned pharmacy, as the Pharmacy Manager, dispenses medications to animals based on prescriptions written by a Doctor of Veterinary Medicine, who has never treated the animals in question, and in fact, lives and works in another state. 5. During the month of October, 2000, the Respondent, filled a prescription for Heartgard Plus Blue without a valid prescription. 6. Based on the foregoing, Respondent’s license to practice pharmacy in the State of Florida is subject to discipline pursuant to Section 465.016(1)(e) Florida Statutes, to wit: 465. 015(2)(c) to sell or dispense drugs as as defined i in s. 465. 003(8) without first being furnished with a prescription. eo WHEREFORE, Petitioner respectfully requests the Board of ‘Pharmacy t to enter é an order i imposing one or more eof the following penalties: 1 revocation or suspension of the Respondent’s license, restriction of the Respondent’s practice, imposition of an administrative fine and assessment of costs related to investigation and prosecution of this case (including, but not limited to costs associated with attorney time), issuance of a reprimand, placement of the Respondent on probation, and/or any other relief that the Board deems appropriate.
