Ross, Respondent. a ADMINISTRATIVE COMPLAINT The Criminal Justice Standards and Training Commission, hereinafter referred to as the Conmission, files this Administrative Complaint against the Respondent, David B. Ross. The Commission seeks to impose disciplinary action upon the “referenced individual © based on the following allegations: 1. _ Respondent was certified by the Criminal Justice Standards and Training Commission on December 22, 1981, and was issued Law Enforcement Certificate _ Number 17563, and Instructor Certificate Number 019~-44-1322. 2. (a) On or ‘between April 15, 1999 and April 12, 2000, the Respondent, David B. Ross, did unlawfully commit a battery upon Barbara Green, by actually touching or striking Barbara Green or intentionally causing bodily harm to Barbara Green against her will. (b) On or between April 5, 1999 and April 12, 2000, the Respondent, David B. Ross, did commit sexual harassment against Barbara Green by engaging ain ‘physical | sonduct of a.sexual nature to wit: attempting to grope and/or grab her ‘breasts and/or attempting to unbutton her blouse and by making inappropriate sexual comments , which had the purpose or effect of unreasonably interfering with said person's work: performance or creating for her an intimidating, hostile or offensive work environment. (c) On or between April 5, 1999 and April 12, 2000, the Respondent, David B. Ross, did unlawfully expose or exhibit his sexual organs in a public place or on the private premises of another, or so near thereto to be seen from such private premises, in a vulgar or indecent manner, or so to expose his person in such place or to go or be naked in such place. 3. The actions of the Respondent did violate the provisions of Section 784.03 and/or 800.03 or any lesser included offenses, Section 943.1395 (6) and/or (7), Florida Statutes, and/or Rules 11B- - 27.0011 (4) (b) | and/or 4c) and/or 11B-20.0012(1) (f), Florida Administrative Code, in that Respondent has failed to maintain the qualifications established in Section 943.13(7), Florida Statutes, which require that a Law Enforcement and Instructor Officer in the State of Florida have good moral character and which gives rise to a disciplinary action against Respondent's certification. 4. This Administrative Complaint is issued pursuant to _ Sections 120.60, 943.12 (3) ‘and 943.1395 (6) and/or (7), Florida Statutes. Any proceedings concerning this Complaint ‘shall be conducted pursuant to Sections 120.569 and 120.57, Florida Statutes, and Rules 11B-27, 28-106, and 28-107, Florida Administrative Code. Mediation is not available under Section 120.573, Florida Statutes. WHEREFORE, it is alleged that the Respondent, pavid B. Ross is guilty of violating “Sections 943.1395 (6) and/or (7), and/or t ee ek Res th fre tiewap cee: cates Repro rer Sernereaney WW TeEs 943.13(7), Florida Statutes, and/or Rules 11B-27.0011(4) (b) and/or (c) and/or 11B-20.0012(1) (f), Florida Administrative Code. NOW, THEREFORE, the Florida Criminal Justice Standards and Training Commission hereby complains against David B. Ross and alleges that an appropriate penalty, as provided in Section 943.1395(6) and/or (7), Florida Statutes, should be imposed for the reasons set forth above and in accordance with the Election of Rights form (to which is attached an Explanation of Rights form) attached hereto and incorporated herein.
