FINAL ORDER
THE Respondent, STATE OF FLORIDA, AGENCY FOR HEALTH CARE
ADMINISTRATION, filed a Motion to Remand Without Prejudice dated
November 30, 2001 and the Administrative Law Judge entered an Order
Closing File on December 3, 2001, which are incorporated by reference. Ina
Final Agency Audit Report dated October 30, 1998, the Agency advised the
Petitioner of an alleged overpayment in the amount of $116,356.35. The
Petitioner submitted additional documentation for review and the overpayment
was adjusted to $2,082.45. Subsequently, the Petitioner submitted additional
documentation on the one patient still at issue and the overpayment was
adjusted to $0. Therefore, the above-styled matter is moot and no other matter
is pending.
Based on the foregoing, the request for a hearing is dismissed and the
file is CLOSED.

parties! Motion to Remand Without Prejudice filed on
November 30, 2001, see Section 120.57(4), Florida Statutes, and
the undersigned being fully advised, it is, therefore,
ORDERED that:
1. The final hearing will not be set as the parties have
negotiated a settlement which will be presented to the Medicaid
Program Integrity.
2. The file of the Division of Administrative Hearings. in
the above-captioned matter is hereby closed with leave for
either party to request the Division to reopen the case, should
the settlement be disapproved by the Medicaid Program Integrity.
