License No. FE 0004225 MICHAEL PAUL GENDRON, Respondent. / ADMINISTRATIVE COMPLAINT Petitioner, DEPARTMENT OF BUSINESS AND PROFESSIONA L REGULATION (hereinafter "Petitioner"), files this Administrative Complaint before the Board of Funeral Directors and Embalmers against MICHAEL PAUL GENDRON, (hereinafter "Respondent"), and alleges: 1. Petitioner is the state agency charged with regulating the practice of funeral directing and embalming, pursuant to Section 20.165, Florida Statutes, and Chapters 455 and 470, Florida Statutes. é . 2. At all times material hereto the Respondent was licensed as a funeral director and embalmer in the State of Florida, having been issued license number FE-0004225. 3. Respondent's address of record is 12 Meadow Street, Ludlow, Vermont, 05149. 4, On or about December 5, 2000, the State of Vermont, Office of Secretary of State, Office of Professional Regulation, Board of Funeral Service, held a default hearing to consider the charges against Respondent. Respondent failed to attend. 5. On or about December 5, 2006, the State of Vermont, “Offic ice of Secretary of State, Office of Professional Regulation, Board of Funeral Service entered a Default Order against Respondent revoking Respondent’s funeral director’s license number 22-1142, embalmer license number 19-1092, and embalmer-trainee license number 20-1108. i | Hi 6. Section 470.036(1)(c), Florida Statutes, states that having a license or registration to practice any of the activities regulated under this chapter revoked, suspended, or otherwise acted against, including the denial of licensure or registration, by the licensing or registering authority of another jurisdiction, constitute grounds for which disciplinary actions may be taken. 7. Based on the foregoing, Respondent has violated Section 470.036(1)(c), Florida Statutes. WHEREFORE, Petitioner respectfully requests the Board of Funeral Directors and Embalmers enter an order imposing one or more of the following penalties: revocation or suspension of the Respondent's license, restriction of the Respondent's practice, imposition of an administrative fine not to exceed $5,000 per violation, issuance of a reprimand, placement of the Respondent on probation, assessment of costs association with the investi gation, imposition of any or all penalties delineated within Section 455.227(2), Florida Statutes, and/or any other relief that the Board is authorized to impose pursuant to Chapters 455 and/or 470, Florida Statutes, and/or the rules promulgated thereunder.
