ADMINISTRATIVE COMPLAINT
RONALD BLOCKER, as Superintendent of Schools for and on behalf of
the School Board of Orange County, Florida, (hereinafter referred to as
“Petitioner’), files this Administrative Complaint against CAROL A. HOSKINS
‘(hereinafter referred to as “Respondent”).
Petitioner seeks the appropriate disciplinary action pursuant to Florida
Statute 231.36.
Petitioner alleges:
1. That Respondent, Carol A. Hoskins, at all times material to this
complaint, was employed as a classroom teacher by the Petitioner,
the School Board of Orange County, Florida.
2. That Respondent Carol A. Hoskins holds a professional services
contract of employment with Petitioner.
3. That Respondent Carol A. Hoskins taught second grade during the
2000/01 school year at Lockhart Elementary School.
4. That on or about September 25, 1995, respondent, Carol A. Hoskins
received a letter of directives (Attachment A) regarding her conduct in
class. These directives resulted from parent complaints and included

warnings regarding physical and verbal intimidation, touching and
unprofessional conduct.
That on or about October 26, 1995, respondent Carol A. Hoskins was
placed on a Performance Improvement Plan (Attachment B) to
monitor her classroom management.
That on or about May 16, 1996, respondent Carol A. Hoskins,
received a letter of reprimand (Attachment C) and on or about May
20, 1996, a letter of directives (Attachment D) for her rude and
disruptive behavior at a Faculty Advisory Committee meeting.
That on or about August 15, 1996, respondent Carol A. Hoskins,
received a written reprimand. (Attachment £) for failing to provide
report cards in a timely manner.
That on or about December 17, 1996 respondent, Caro! A. Hoskins
received a written reprimand (Attachment F) for insubordination when
she refused to meet with an administrator to discuss her work
performance.
That on or about May 12, 1999, respondent violated previously
issued directives when she was involved in a dispute with another
staff member and physically struck him. As a result of this incident
the respondent and petitioner agreed to a settlement agreement.
That on or about April 12, 2000, respondent signed a settlement
agreement (Attachment G) which included: a written reprimand
(Attachment H), a referral to the Employee Assistance Program, a
transfer to another school and an agreement that any additional
violations of unlawful physical contact shall be grounds for her
dismissal.
That on or about February 15, 2001, respondent was accused by one
of her students with hitting him on the arm and jeg. During a pre-
determination investigative meeting on March 2, 2001, respondent

admitted touching the student on the arm to redirect him to line up. At
this meeting the respondent was directed to follow school policies
and procedures for non-compliant students and to not touch students
except as necessary to perform her assigned duties. While this
incident was being investigated and prior to a determination being
made as to the proper management response, respondent was
involved in another incident regarding inappropriately touching a
student.
That on or about March 23, 2001, respondent reported that she had
grabbed a student by the arm to remove the student from class. At
the pre-determination meeting for this incident, the respondent stated
that she had difficulty getting a response for assistance from
administrative staff when dealing with disruptive students and she
was justified in grabbing this student. This incident occurred in
another teacher's classroom and this teacher states that the
respondent grabbed the student and removed her from the classroom
prior to the respondent's call to the office for assistance.
Respondent's actions are in direct violation of the previously issued
directives.
Such actions by Respondent, Carol A. Hoskins, are violative of the
ethical standards for members of the education profession in Florida
and constitute misconduct in office, gross insubordination and willful
neglect of duty; a breach of Respondent's employment agreement
with the School Board and a breach of the standards of ethics for
members of the teaching profession in Florida.
Misconduct in office, gross insubordination and/or willful neglect of
duty and/or breach of her employment agreement, are sufficient
grounds to sever the professional services contract status of
Respondent, Caro! A. Hoskins and to terminate her employment with
the Schoo! Board of Orange County, Florida.
THEREFORE, the Superintendent of Schools for the School Board of
Orange County, Florida recommends that the Board sever its professional
services contract relationship with the Respondent and terminate immediately
the employment of Respondent, Carol A. Hoskins.

This memorandum will serve as a summary of our meeting on
September 25, 1995. On that date we mat in my office to discuss
concerns pertaining to job efficlency. You will recall that | issued the
following directives:
1. You are to conduct yourseif In a professional manner at all
times while interacting with students, staff, and community.
2. You are not to touch students except-as absolutely necessary to
perform your professional responsibilities.
3. You are to avoid the appearance of physica! intimidation.
4. You must avoid even the appearance of verbal intimidation while
dealing with students. This includes, but ls not limited to, yelling,
comments of disparaging nature, or actions which subject students to
embarrassment.

Dear Ms. Hoskins:
This letter shall serve as a written reprimand and a summary of a pradisciplinary meeting
held on February 23, 1996. During that meeting we discussed alleged misconduct on your part.
Specifically, your unprofessional and disruptive behavior during a F.A.C. meeting on February 6,
1996. Your remarks during this meeting were rude, unkind and you kept angrily interrupting the
meeting. You used poor judgment and behaved in an inappropriate manner among your fellow co-
workers. Your behavior was perceived by your co-workers as threatening and hostile. :
| am particularly disturbed by this conduct, as it is similar to past misconduct on your part. In
September of 1995 you were issued a directive by your principal specifying that you Were to conduct
yourself in a professional manner at all times while interacting with students, staff and the
community. moe
Given the serious nature of the misconduct, | am issuing you this reprimand for failing to
follow previously issued directives and failure to meet the expectations of management. Upon your
request this letter shall be appended with a statement that it is outdated and deemed no longer
relevant for disciplinary purposes provided there are no similar problems for a period of two years.
