Estate (“Petitioner”) files this Administrative Complaint against Richard L. Hehl, Jr.
(“Respondent”) and alleges:
ESSENTIAL ALLEGATIONS OF MATERIAL FACT
1. Petitioner is a state government licensing and regulatory agency charged with the
responsibility and duty to prosecute Administrative Complaints pursuant to the laws of the State
of Florida, in particular Section 20.165 and Chapters 120, 455 and 475 of the Florida Statutes
and the rules promulgated pursuant thereto.
2. Respondent is and was at all times material hereto a licensed Florida real estate broker,
issued license number 3000622 in accordance with Chapter 475 of the Florida Statutes.
3. The last license issued was as an active broker c/o The Home Team USA, Inc., 569
Crystal Drive, Madeira Beach, Florida 33708.

4. On or about February 23, 1999, in Pinellas County, Florida, Respondent, without the
permission of the owner or the listing brokerage, gained access to the inside of a property through
an electronic lock box.
5. While inside the residence, Respondent engaged in sexual activity with a person he
brought into the property.
6. Officers from the St. Petersburg Police Department observed Respondent engaging in
sexual activity with the person inside the property. A copy of the police report is attached hereto and
incorporated herein as Exhibit 1.
7. The officers arrested Respondent for Prostitution and Burglary.
8. On or about September 27, 1999, in Pinellas County, Florida, Respondent entered into a
pretrial intervention program for the charge of Prostitution and reduced charge of Trespass. A copy
of the pretrial intervention agreement is attached hereto and incorporated herein as Exhibit 2.
COUNT I
Based upon the foregoing, Respondent is guilty of dishonest dealing by trick, scheme or device,
or breach of trust in any business transaction in violation of Section 475 .25(1)(b), Florida Statutes.
WHEREFORE, Petitioner respectfully requests the Florida Real Estate Commission, or
the Department of Business and Professional Regulation, as may be appropriate, to issue a Final
Order as final agency action finding the Respondent(s) guilty as charged. The penalties which
may be imposed for violation(s) of Chapter 475 of the Florida Statutes, depending upon the

severity of the offense(s), include: revocation of the license or registration or permit; suspension
of the license, registration or permit for a period not to exceed ten (10) years, imposition of an
administrative fine of up to $1,000 for each count or offense; imposition of investigative costs;
issuance of a reprimand; imposition of probation subject to terms including, but not limited to,
requiring the licensee, registrant or permitee to complete and pass additional real estate education
courses; publication; or any combination of the foregoing which may apply. See § 475.25(1),
Fla. Stat. (1999) and Fla. Admin. Code R. 61J2-24.001. The penalties which may be imposed for
violation(s) of Chapter 455 of the Florida Statutes, depending upon the severity of the offense(s),
include: revocation of the license, registration, or permit; suspension of the license, registration,
or permit for a period not to exceed ten (10) years; imposition of an administrative fine of up to
$5,000 for each count or offense; imposition of investigative costs; issuance of a reprimand;
imposition of probation subject to terms including, but not limited to, requiring the licensee,
registrant, or permitee to complete and pass additional real estate education courses; publication;
restriction of practice; injunctive or mandamus relief; imposition of a cease and desist order; or
any combination of the foregoing which may apply. See § 455.227, Fla. Stat. (1999) and Fla.
Admin. Code R. 61J2-24.001.

I am the Community Police Officer for the Uptown Neighborhood. On this night,
I was working with the other captioned officers in plain clothes and in
unmarked cars. After Officer Quinn and Officer LaMonde witnessed HOLLIN get
into a black’ Ford Explorer, we moved in to assist in a surveillance. We
followed the vehicle for about 30 minutes as it drove through the Old Northeast
neighborhood. The vehicle then drove north on 1st Street and stopped at a
house near 34th Avenue North and 1st Street.
HOLLIN and HEHL both exited the car and walked up to the house out of our view.
The house had a realtor sign in the front yard. Less than one minute later,
they returned to the truck and drove off. They stopped again at a second house
about two blocks away. Again they both exited the car and walked to the house.
They got back into the car less than one minute later. They then drove and
parked in front of 209 35th Avenue North. They walked to the front door and
then entered the house.
This house was for sale with a Value Properties realtor sign in the front yard..
The house was vacant of all furniture and did not have any curtains in the
windows. There was also a realtor's lock box on the front door. We walked up
on the house. I was on the east side of the house and saw HEHL's back facing
the kitchen window. As I got closer, I could see he was leaning against a
counter. He had his pants unzipped with his penis oexposed. HOLLIN was on her

On 2/26/99 I spoke to RODETSKY on the phone. He is the realtor that has
the property listed. He is also the trustee for the property. He told me that
he spoke to the family that owns the house and that they wish to prosecute. I
then responded to HEHL's residence at 1430 hours where he was arrested and
charged with burglary. A live State Attorney's Invest will be set for this
case.

On this date I was working with Ofc. LAMONDE in an unmarked vehicle addressing
the prostitution problems along 4th street north and in the Round Lake
neighborhood. Ofcs. ALLEN and MacDONALD were assisting us utilizing another
unmarked vehicle. We observed a known prostitute ANITA HOLLIN walking
eastbound on 9 avenue from 8 street north and decided to watch her actions.
After a few minutes she caught the attention of a vehicle being driven by
RICHARD HEHL as he pulled over near $ avenue and 7 street north. She entered
the vehicle and they drove from the area northbound on 4 street. For the next
thirty minutes they drove around neighberhceods north of 20 avenue until stopping
at a residence on 1 street near 33.avenue north. Both subjects exited the
vehicle and walked up to the front door of a vacant residence (the house
was for sale with a realtor sign in the front yard). They did not enter this
residence.
They re-entered the vehicle and drove around this neighborhood finally pulling
up in front of 209 35 avenue north. It should be noted this residence was also
vacant with a realtor sign in the front yard. They entered this residence.
About this time we figured HEHL was a realtor and had been looking for a vacant
residence to commit the act of prostitution.
We moved up to the residence and noted there were no window treatments
thoughout the house. Ofc. ALLEN and I observed HOLLIN giving HEHL a blowjob in
the northeast section of the house. We were able to get their attention and
eventually HEHL opened the front door to permit us entry.
I advised HOLLIN cf her miranda rights and she agreed to speak to me. At first
HOLLIN advised she was looking at the house, but changed her story when she
realized my identity and the fact I told her she was not being truthful. She
advised HEHL picked her up and solicited her for a blowjcb. He told her he
only had $14.00 so she received this for providing the oral sex. The $14.00
dollars was located in her top pocket of the dress she was wearing. I seized
the currency and turned it over to Ofc. ALLEN.

Alleged Violation: 475.25(1)(B) Breach of Trust & 475.25(1)(F) Plead guilty to a crime which directly relates to
the activities of a licensed broker and involves moral turpitude.
Synopsis: This investigation is predicated upon a complaint (Exh.1) submitted by BPR in- regard to HEHL
alleging that HEHL utilized a listed property for the purpose of prostitution and was subsequently criminally
charged and found guilty. .
HEHL was notified of the investigation by letter dated 02/25/2000 (Exh.2) and a copy of the complaint was
provided.
A check of BPR computer records revealed HEHL is currently licensed as an active broker (Exh.3). BOBBIE
JEAN CALDWELL is an active broker with REALTY CENTER INC(Exh.4). HOWARD RODETSKY is an active
salesperson with VALUE PROPERTIES OF CENTRAL FLORIDA INC(Exh.5). GLORIA RODETSKY is an active
broker with VALUE PROPERTIES OF CENTRAL FLORIDA INC(Exh.6).
Investigation disclosed: On March 7, 2000 HEHL was telephonically interviewed (727-638-2186).
HEHL admitted he had been arrested for prostitution and burglary, but denied any wrong doing.
HEHL stated he was advised by “FARBAR’(sic, meaning the Florida Association of Realtors legal
hotline), he was not required to report the incident, due to the fact he was not convicted of a felony.
HEHL’S burglary charge was dropped to trespass and HEHL plead guilty to the two misdemeanor
charges. Subsequently, HEHL was ordered to comply with a Pre-trial Intervention Agreement(Exh.7)
HEHL stated the only reason he plead guilty, was because it wasn’t worth the attorney's fees to fight
the misdemeanor charges. HEHL stated the woman he was with when arrested, was a potential real
estate client he met that day while at a downtown bank. HEHL alleged the woman requested he show
her some houses that were “no money down” properties. HEHL accused the officers’ of being “over
zealous” and lying on the arrest affidavit(Exh.8). HEHL advised that he was the broker for REALTY
CENTER INC at the time of his arrest. HEHL related that he is no longer employed as a broker and
is presently pursuing a career in the mortgage industry. (CONTINUED

On March 20, 2000 per verbal request, this office received a copy of the ST.PETERSBURG POLICE
DEPARTMENT police report reference HEHL’S arrest(Exh.9)
On March 20, 2000 HOWARD RODETSKY was telephonically interviewed (727-593-3353). RODETSKY
stated that he was the listing agent and Vice President Trustee for the property at 209 35" Ave. North,
in St.Petersburg, Florida during the time HEHL was arrested. RODETSKY stated that the house has
since been sold and the trust dissolved. RODETSKY advised he would not be willing to divulge who he
was trustee for without a court order. RODESTKY related the fact he had contacted his client at the time
of the original prostitution arrest. His client, according to RODESTKY, was willing to prosecute for
trespass/burglary, but RODESTKY was the one who signed the criminal complaint against HEHL.
RODETSKY agreed that he and his client were victims of a “Breach of Trust.”
On March 21, 2000 BOBBIE JEAN CALDWELL, the present broker of record for REALTY CENTER INC.,
faxed this office a completed Inspection Form(Exh.10). CALDWELL telephonically confirmed (727-381-
2255) she presently holds no escrow.
An Audit/Inspection is scheduled for VALUE PROPERTIES on March 29, 2000(Exh. 1 1).
On March 24, the arresting officer, DOUGLAS ALLEN, was telephonically interviewed(727-893-7780).
ALLEN confirmed that he witnessed the sexual act HEHL was arrested for.
