ADMINISTRATIVE COMPLAINT The Criminal Justice Standards and ‘Training Commission, hereinafter referred to as the Commission, files this Administrative “The Commission Complaint “against” “the Re. seeks to impose disciplinary action upon ‘the referenced individual based on the following allegations: | 1. Respondent was certified by the Criminal Justice Standards and Training Commission on December 1, 1987, and was issued Law Enforcement Certificate Number 54276. 2. (a) On or between November 10, 1993 and June 20, 2001, the Respondent, Barry C. Lombard, did unlawfully introduce into or possess upon the grounds of the Gilchrist County Jail, a county detention facility, or give to or receive from any inmate of said facility, or take or attempt to take or send therefrom, food, tobacco products, currency, an article or thing declared to be contraband pursuant to section 951.22(1). (b) On or between November 10, 1993 and June 20, 2001 the Respondent, Barry C. Lombard, did then corruptly use or attempt to SCARE RR enon a SOR RIETT EE use his/her official position as a Corrections officer, or any property or resource within his trust, or did perform his/her official duties, in such a manner as to secure a special privilege, benefit, or exemption ‘for himsel£/hersel£ or others, to wit: allowed inmates to receive food ‘items, tobacco products and/or currency to which they were not entitled. (c) On or between November 10, 1993 and June 20, 2001 the Respondent, Barry C. Lombard, did then corruptly use or attempt to use his/her official position as a Corrections officer, or any _ property or resource “within: his trust, or did perform ‘his official duties, in such a manner as to secure a special privilege, benefit, or exemption for himself/herself or others, to wit: allowed correctional officers to have inmates wash their personal vehicles. — (ad) On or between December 1, 2000 and December 26, 2000 the Respondent, Barry Cc. Lombard, did’ then corruptly use or attempt to use his/her official position as a Corrections officer, or any property or resource within his trust, or did perform his/her official duties, in such a manner as to secure a special privilege, benefit, or exemption for himself/herself or others, to wit: Instructed correctional officers under his supervision to use county property and inmate labor to disassemble, transport and reassemble a trampoline sold by him to an inmate’s girlfriend. 3. The actions of the Respondent did violate the provisions of Section 951.22(1) or any lesser included offenses, Section 943.1395 (6) and/or (7), Florida Statutes, and/or Rule 11B- 27.0011(4) (a) and/or (c), Florida Administrative Code, in that Respondent has failed to maintain the qualifications established in Section 943.13(7), Florida Statutes, which require that a Law ne ccomorre ee ae Tera ‘Enforcement Officer in the State of Florida have good moral character. 4. This Administrative Complaint is issued pursuant to Sections 120.60, and 943.1395(6) and/or (7), Florida Statutes. Any proceedings concerning this Complaint shall be conducted pursuant to Sections 120.569 and 120.57, Florida Statutes, and Rules 11B-27, 28-106, and 28-107, Florida Administrative Code. Mediation is not available under Section 120.573, Florida Statutes. WHEREFORE, it is alleged that the Respondent, Barry C. Lombard guilty of violat 943.13(7), Florida Statutes, and/or Rule 11B-27.0011(4) (a) and/or "COMMISSION THIS 4 DAY OF SEPTEMBER, 2001. (c), Florida Administrative Code. NOW, THEREFORE, the Florida Criminal Justice Standards and Training Commission hereby complains against Barry C. Lombard and alleges that an appropriate penalty, as provided in Section 943.1395(6) and/or (7), Florida Statutes, should be imposed for the reasons set forth above and in accordance with the Election of Rights form (to which is attached an Explanation of Rights form) attached hereto and incorporated herein.
