ADMINISTRATIVE COMPLAINT COMES NOW the Agency for Health Care Administration (hereinafter “AHCA”), by and through the undersigned counsel, and files this Administrative Complaint against Maria Marin, AFCH (hereinafter “Respondent”) and alleges: NATURE OF THE ACTION 1. This is an action to impose an administrative fine on Respondent in the amount of two hundred fifty dollars ($250) pursuant to Section 400.6196(1) (c) Florida Statutes and Rule 58A-14.010(6) (a) F.A.C. 2. On or about November 08, 2001 a follow-up survey was conducted of the Respondent’s facility to determine the status of those deficiencies cited during the facility’s COR IR RRR ER CoRR eT CTR Ree opr COREE On Or rare RRR em iE OFT cE Scary Te eereper errr annual state licensure survey conducted on or _ about September, 25, 2001. It was determined that the deficiency set forth in Count I below and originally cited during the September 25, 2001 survey, remained uncorrected. Jurisdiction And Venue 3. This Court has jurisdiction pursuant to Section 120.569 and 120.57 Florida Statutes and Chapter 28-106 Florida Administrative Code. 4, Venue lies in Hillsborough County, Division of Administrative Hearings, pursuant to 120.57 Florida Statutes, and Chapter 28 Florida Administrative Code. Parties 5. AHCA, Agency for Health Care Administration, State of Florida, is the enforcing authority with regard to Adult Family Care Home licensure law pursuant to Chapter 400, Part VII, Florida Statutes and Rules 58A-14, Florida Administrative Code. 6. Respondent, is an Adult Family-Care Home located at 2915 Tampa Bay Blvd. Tampa, Florida. Respondent, is and was at all times material hereto, a licensed facility under Chapter 400, Part VII, Florida Statutes and Chapter 58A-14, Florida Administrative Code. eee ne erm”
