DMINISTRATIVE COMPLAINT The Petitioner alleges: JURISDICTION 1. The Respondent holds Florida Educator’s Certificate 604240, covering the area of Physical Education, which is valid through June 30, 2003, 2. At all times pertinent hereto, the Respondent was err ployed as a Physical Education teacher at Springstead High School, in the Hernando County Scho 9] District. MATERIAL ALLEGATIONS 3. On or about April 1, 1998, Respondent had the schoo} generate a check for $2,505.00 made out to an employee of a local sporting goods company althou zh the school currently did not owe the company and money. The employee cashed the check and gave Respondent $2,505.00 of the money that Respondent used for his personal expenses. 4, On or about June 4, 1998, Respondent received another check for $300.00 made out to the employee of the local Sporting goods company although the school did not owe the company Anthony Zefiretto Administrative Complaint .. 2 of 3 and money. The employee cashed the check and gave Respondent $295.00 to use for his personal expenses, _ 5. During 1998 Respondent received between $3,100.00 and $5,000.00 from the sporting goods company to insure that Respondent arranged for the company to still receive business from Respondent’s school, and to encourage Respondent improperly to encourage other athletic directors to purchase goods from the sporting goods company. 6. On or about August 18, 1998, Respondent took $39.00 from a cash box which held money to be used for school purposes. When the shortage was discovered Respondent directed school personnel to falsify records so the shortage would not be noticed. STATUTE VIOLATIONS COUNT 1: The Respondent is in violation of Section 231.28(1)(c), Florida Statutes, in that Respondent has been guilty of gross immorality or an act involving moral turpitude. COUNT 2: The Respondent is in violation of Section 231.28(1)(), Florida Statutes, in that Respondent has been found guilty of personal conduct which seriously reduces his effectiveness as an employee of the school board. COUNT 3: The Respondent is in violation of Section 231.28(1)(i), Florida Statutes, in that Respondent has violated the Principles of Professional Conduct for the Education Profession prescribed by State Board of Education rules. COUNT 6: The Respondent is in violation of Rule 6B.1006(5)(h), F.A.C., in that Respondent has submitted fraudulent information on a document in connection with professional activities. WHEREFORE, the Petitioner recommends that the Education Practices Commission impose an appropriate penalty pursuant to the authority prc vided in Sections 231.262(6) and 231.28(1), Florida Statutes, which penalty may include a repr’ mand, probation.
