ROLLE, “Respondent. ADMINISTRATIVE COMPLAINT Petitioner, TOM GALLAGHER, as Commissioner of Education, files this Administrative _ Complaint against Harry G. Rolle. The Petitioner seeks the appropriate disciplinary sanction of the Respondent’s educator’s certificate pursuant to Sections 231.262 and 231.28, Florida Statutes, and pursuant to Rule 6B-1.006, Florida Administrative Code, Prinziples of Professional Conduct for the Education Profession in Florida, said sanctions specifically set forth in Sections 231.262(6) and 231.28(1), Florida Statutes. 1, The Respondent holds Florida Educator’s Certificate 304244, covering the area of ning Disabilities, which is valid through June 30, 2002. all times pertinent hereto, the Respondent was ‘employed as an ESE teacher at - Miami Beach Senior High School, in the Miami-Dade Count, School District. MATERIAL ALLEGATIONS 3. Onor about August 5, 1999, Respondent was in possession of a controlled substance Cocaine, and driving with a fake auto tag with a suspended driver’s license. Respondent was arrested and charged with Possession of Cocaine, Counterfeit Teraporary Tag, Driving While License Suspended and Violation of Driver License Restrictions. On or about October 6, 1999, Respondent was found Guilty of the charge of Possession of Cocaine while the other charges were dismissed. Respondent was sentenced to court costs and time served (two days in jail). { F | ; eek dea Le Harry G. Rolle Administrative Complaint * Page 2 of 2 STATUTORY VIOLATIONS COUNT 1: The allegations of misconduct set fo th herein are in violation of Section 231.28(1)(c), Florida Statutes, in that Respondent has beer guilty of gross immorality or an act involving moral turpitude. COUNT 2: ‘The allegations of misconduct set foth herein are in violation of Séction 231. 28(1)(e), Florida Statutes, in that Respondent has been convicted of a misdemeanor, felony, or other criminal charge, other than a minor traffic violation. COUNT 3: The allegations of misconduct s set fo-th herein a are in n violation of Section 231.28(1)(f), Florida Statutes, in that Respondent, upon irvestigation, has been found guilty of personal conduct which seriously reduces his effectiveness as: an employee of the school board.
