On May 10, 2002, both the Notice of Intent to Deny and the Petition for Formal Administrative Hearing were forwarded to the Division of Administrative Hearings by the Agency and assigned to an Administrative Law Judge. The case was then placed in abeyance at the request of both parties. On March 22, 2005, both parties filed a Stipulation for Voluntary Dismissal wherein the parties stipulated that they were withdrawing and dismissing any and all claims that each may have had that were the subject matter of the case, and that each party would bear all of its own attorney’s fees and costs for the matter. On March 23, 2005, the Administrative Law Judge assigned to the case issued an Order Closing File based on the parties’ Stipulation for Voluntary Dismissal. IT IS THEREFORE ORDERED AND ADJUDGED THAT: Both the Notice of Intent to Deny and the Petition for Formal Administrative Hearing are dismissed and the case is closed.
