CASE NUMBER: 01-04626 FRANK SCAFIDI, RESPONDENT. oo, : / ADMINISTRATIVE COMPLAINT "Petitioner", and files this Administrative Complaint before the Board of Psychology against Frank Scafidi, hereinafter referred to as "Respondent", and alleges: consumer complaint,- investigative, and prosecutorial Services required by the Division of 3. Respondent's last known address is 18799 Northwest go Avenue, Miami, Florida 33015-2742. 4. The Respondent is the Director of Clinical Services at “The Village,” a rehabilitation treatment facility that provides room and board, food and medication for clients and their children. 5. On or about June 14, 2000, LR., a pediatric nurse and employee of The Village, Submitted a written report to the Respondent regarding suspected child abuse or neglect. The ,» Teport contained a detailed description of the lack of medical care and attention that a mother was - giving to her children, This negligent condition existed even though the mother bad been provided with the necessary medications to administer to the children. 6. The Respondent did not report the suspected neglect to the Department of Children and Family Services, ) 7. Section 39.201, Florida Statutes, mandates that any person who has reasonable cause to suspect that a child is neglected by a parent shall report such Suspicion to the Department of Children and Family Services. 8. Section 39.01(45), Florida Statutes, states that “neglect” occurs when a child is deprived of necessary medical treatment. 9. Therefote, based on the foregoing Respondent has violated Section 490.009(2)(h), Florida Statutes, through a violation of Section 39.201, Florida Statutes, by failing to report suspected child abuse or neglect; and, Section 490.009(2)(s), Florida Statutes, by failing to meet the minimum standards of performance in professional activities, WHEREFORE, Petitioner respectfully requests that the Board of Psychology enter an order imposing one or more of the following penalties: revocation or suspension of the Respondent's license, restriction of the Respondent's practice, imposition of an administrative fine, issuance of a reprimand, placement of the Respondent on probation, and/or any other relief that the Board deems appropriate.
