FINAL ORDER
THIS CAUSE CAME before me for the purpose of issuing a final agency order, upon an
order of Administrative Law Judge David M. Maloney, attached hereto, dismissing the case, it
appearing from the Petitioner’s Notice of Voluntary Dismissal, attached hereto, that there are no
disputed issues of fact.
FINDINGS OF FACT
1. On March 24, 2003, Petitioner filed its Notice of Voluntary Dismissal. On March
25, 2003, Administrative Law Judge David M. Maloney entered the Order Closing File.
2. The Agency hereby adopts and incorporates by reference the attached Notice of
Voluntary Dismissal and Order Closing File.
3. There are no remaining disputed issues of fact or law.
CONCLUSIONS OF LAW
The Agency for Health Care Administration has jurisdiction over the parties and subject
matter pursuant to Sections 120.569 and 120.57, Fla. Stat. (2002).
Based on the foregoing,
IT IS ADJUDGED THAT:
Notami Hospitals of Florida, Inc.’s petition challenging the denial of Certificate of Need
(CON) Application Number 9592, which sought to convert 20-adult psychiatric beds to 20 acute
care beds at Lake City Medical Center located in Columbia County, District 3, Subdistrict 1, is
dismissed.

The proposal by Notami Hospitals of Florida, Inc.. to convert 20 adult psychiatric beds to 20 acute care
beds at Lake City Medical Center located in Columbia County, District 3, Subdistrict 1, has been
reviewed by this office according to Section 408.039, Florida Statutes, and Chapter 59C-1, Florida
Administrative Code. It is the determination of this office that your proposal is denied.
Reasons and explanations for this denial are found in the attached State Agency Action Report.
You have the right to challenge this decision by requesting an administrative hearing under the provisions
of Florida's Administrative Procedure Act, Chapter 120, Florida Statutes, and under Rule 59C-1 .010,
Florida Administrative Code. A request for hearing, if any, must be in writing and must be actually
received by this agency within 21 days after the publication in the Florida Administrative Weekly.
A request for hearing must contain the information required in Rule 28-5.201, Florida Administrative
Code, and must make reference to the "CON Action Number" mentioned in this letter. In addition, a
request for hearing must indicate whether your proposal was reviewed comparatively with any other
proposals and, if so, make reference to the names and CON Action Numbers of those proposals. The
