ADMINISTRATIVE COMPLAINT Petitioner, CHARLIE CRIST, as Commissioner of Education, files this Administrative Complaint against MARJORIE J. McWEENY. The Petitioner seeks the appropriate disciplinary sanctions of the Respondent’s Educator’s Certificate pursuant to Sections 231.262 and 231.2615, Florida Statutes zand pursuant -to Rule 6B-1.006, Florida Administrative Code, Principles of Professional Conduct for the Education Profession in Florida, said ‘sanctions specifically set forth in sections 231.262(6) and 231.2615(1), Flonda Statutes. The Petitioner alleges: JURISDICTION 1. The Respondent holds Florida Educator’s Certificate no. 580761, covering the area of Art, which is valid through June 30, 2004. 2. At all times pertinent hereto, the Respondent was employed as an Art teacher, at Mays Middle School, in the Miami-Dade County School District. LLL TS Marjorie J. Mc Weeny Administrative Complaint Case No. 001-0827-V MATERIAL ALLEGATIONS 3. On or about October 12, 2000, the Respondent encouraged her former magnet school students to write and enlist their parent’s assistance in writing to the Superintendent of Schools to complain about her current personnel assignment to a non- magnet program. The students, including Cristina Pazos and Hilary Loftos, were directed to bypass the lead teacher and the School's Principal in this matter. 4. The Respondent’s conduct was reported to the Bureau of Educator Standards. On or about November 30, 2000, the Respondent was issued a letter of reprimand. The Respondent continues to be employed by the Miami-Dade County Public School District. STATUTORY VIOLATIONS COUNT I: The Respondent is in violation of Section 231.2615(1)(), Florida Statutes, in that Respondent has violated the Principles of Professional Conduct for the Education Profession prescribed by State Board of Education Rules. RULE VIOLATIONS GOUNT II: The allegations of misconduct set forth herein are in violation of Rule 6B-1.006(3)(h), Florida Administrative Code, in that Respondent has exploited a relationship with a student for personal gain or advantage. WHEREFORE, the Petitioner recommends that the Education Practices Commission impose an appropriate penalty pursuant to the authority provided in Sections 231.262(6) and 231.2615(1), Florida Statutes, which penalty may include a reprimand, probation, restriction of the authorized scope of practice, administrative fine, suspension of the teaching certificate not to exceed three (3) years, permanent revocation of the teaching -2- a RR Marjorie J. McWeeny Administrative Complaint Case No. 001-0827-V certificate or combination thereof, for the reasons set forth herein and in accordance with the Explanation and Election of Rights forms which are attached hereto and made a part hereof by reference.
