HALL, Respondent. ADMINISTRATIVE COMPLAINT Petitioner, Charlie Crist, as Commissioner of Education, files this Administrative Complaint against STANLEY L. HALL. The Petitioner seeks the appropriate disciplinary sanction of the Respondent’s Educator’s Certificate pursuant to Sections 231.262 and 231.2615, Florida Statutes, and pursuant to Rule 6B-1.006, Florida Administrative Code, Principles of Professional Conduct for the Education Profession in Florida, said sanctions specifically set forth in Sections 231.262(7) and 231.2615(1), Florida Statutes. The Petitioner alleges: JURISDICTION 1. The Respondent holds Florida Educator’s Certificate 754323, covering the area,of Marketing, which was valid through June 30, 2002. 2. Atall times pertinent hereto, the Respondent was employed as an Exceptional Student Education teacher at Spruce Creek High School in the Volusia County School District. MATERIAL ALLEGATIONS 3. On or about June 3, 2000, the Respondent entered the dwelling of Elizabeth M. Landry and Jean A. Hall with the intent to commit an offense therein and intentionally touched Jean A. Hall against her will or intentionally caused bodily harm to Jean A. Hall. He entered the residence through a window without the consent of the residents and choked Jean A. Hall with his hands against her will and/or caused her bodily harm. The Respondent was married to Ms. Hall but separated at the time. The Respondent was charged with Burglary of a Residence and Domestic Violence Battery. On or about June 23, 2000, the State Attorney’s Office announced a “No Information” on the charges. STANLEY L. HALL Administrative Complaint Page 2 of 2 4. On or about May 21, 2001, the Respondent received notice that his principal would not be re-appointing him for the 2001-2002 school year. 5. On or about June 20, 2001, the Respondent got into an argument with Jean A. Hall at a motel and, with an apparent ability to carry it out, threatened to do violence to her in such a manner that she had a well-founded fear that such violence was imminent. He told her that he was going to bury her alive in the woods where she would not be found. He then drove with her in the vehicle while forcibly holding her wrist against her will to prevent her from opening the door. As stated above, the Respondent was married at the time or had previously been married to Ms. Hall. The Respondent was arrested and charged with Domestic Violence Battery, Domestic Violence Assault, False Imprisonment and Resisting an Officer Without Violence. When he was being booked into the jail, the Respondent refused to provide any personal information, refused to stand in front of the camera for a book-in photo, refused to put his hands on the wall while being frisked and refused to have his fingerprints taken, which constituted the Resisting Without Violence charge. On or about June 19, 2001, the Respondent, with an apparent ability to carry it out, had also threatened to kill Ms. Hall in front of her children, causing her to fear for her life. He was not charged with this earlier offense. On or about July 16, 2001, the State Attorney’s Office announced a “No Information” on the charges stemming from June 20, 2001. STATUTORY VIOLATIONS COUNT 1: The allegations of misconduct set forth herein are in violation of Section 231.2615(1)(c), Florida Statutes, in that Respondent has been guilty of gross immorality or an act involving moral turpitude. WHEREFORE, the Petitioner recommends that the Education Practices Commission impose an appropriate penalty pursuant to the authority provided in Sections 231.262(7) and 231 .2615(1), Florida Statutes, which penalty may include a reprimand, probation, restriction of the authorized scope of practice, administrative fine, suspension of the teaching certificate not to exceed three years, permanent revocation of the teaching certificate, or combination thereof, for the reasons set forth herein, and in accordance with the Explanation and Election of Rights forms which are attached hereto and made a part hereof by reference.
