I FINAL ORDER THIS CAUSE concerns a Petition for Formal Administrative Proceedings that the Petitioner filed on April 12, 2004, and a Petition to Intervene that the Intervenor filed on April 21, 2004. Both Petitions were filed with the Division of Administrative Hearings and assigned to an Administrative Law Judge. On or about March 25, 2004, the Intervenor filed a Notice of Voluntary Dismissal stating it was withdrawing its Petition to Intervene. On or about May 18, 2004, the Petitioner filed a Notice of Voluntary Dismissal stating it was withdrawing its Petition for Formal Administrative Hearing. On or about May 19, 2004, the Administrative Law Judge assigned to the case issued an Order Closing File based on the both the Intervenor and Petitioner’s Notices of Voluntary Dismissal.
