Petitioner has filed an Administrative Complaint seeking disciplinary action against the license. A copy of the Administrative Complaint is attached to and made a part of this Final Order. Petitioner was represented by Brian Stabley, Assistant Attorney General. Respondent was not present. Upon consideration it is ordered: 1. The material facts are not in dispute. 2. Petitioner’s motion for final order is granted. 3. The allegations of fact set forth in the Administrative Complaint are approved, adopted and incorporated herein by reference as the findings of fact by the Board. 4. The allegations of law alleged and set forth in the Administrative Complaint are approved, adopted and incorporated herein by reference as the conclusions of law by the Board. 5. The violations set forth warrant disciplinary action by the Board. 6. The Petitioner’s Motion to Assess Costs of Investigation and Prosecution is granted. THEREFORE IT IS ORDERED AND ADJUDGED: 1. Respondent shall pay an administrative fine in the amount of $1000.00 to the Board within thirty days of the date this Final Order is filed. Payment shall be made to the Board of Massage Therapy and mailed to, DOH-Client Services, P.O. Box 6320, Tallahassee, Florida 32314-6320, Attention: Massage Therapy Compliance Officer. 2. The Board reviewed the Petitioner’s Motion to Assess Costs and imposes the costs associated with this case in the amount of $ 1588.99 to be paid within 30 days from the date this final order is filed. Payment shall be made to the Board of Massage Therapy and mailed to, DOH-Client Services, P.O. Box 6320, Tallahassee, Florida 32314-6320, Attention: Massage Therapy Compliance Officer. 3. Respondent’s license to practice massage therapy is hereby revoked. This Final Order shall become effective upon filing with the Clerk of the Department of Health.
