FINAL ORDER THIS CAUSE concerns the Petition for Formal Administrative Proceedings that Petitioner, Hope of Southwest Florida, Inc. (“Hope”), filed on September 27, 2004. On October 26, 2004, the Petition was forwarded to the Division of Administrative Hearings (“DOAH”), by the Agency and assigned to an Administrative Law Judge. | A Petition to Intervene was filed by Hospice of Southwest Florida, Inc. on October 26, 2004, which was granted by the ALJ on November 1, 2004, The Petitions above are related to the Agency’s denial of Certificate of Need Application 9794. On April 3, 2006, Petitioner Hope filed a Notice of Voluntary Dismissal of its Petition. On April 4, 2006, the Administrative Law Judge assigned to the case issued an Order Closing File based on the Notice of Voluntary Dismissal.
