Hale, Jr., nesponcent. CY YCATPL ADMINISTRATIVE COMPLAINT The Criminal Justice Standards and Training Commission, hereinafter referred to as the Commission, files this Administrative Complaint against the Respondent, Daniel G. Hale, Jr. The Commission seeks to impose disciplinary action upon the referenced individual based on the following allegations: 1. Respondent was certified by the Criminal Justice Standards and Training Commission on October 25, 1999, and was issued Correctional Certificate Number 187826. 2. (a) On or about June 11, 2002, the Respondent, Daniel G. Hale, dr., did unlawfully expose or exhibit his sexual organs in a public place or on the private premises of another, or so near thereto as to be seen from such private premises, in a vulgar or indecent manner, or so to expose his person in such place or to go or be naked in such place. (b) On or about June 29, 2002, the Respondent, Daniel G. Hale, Jr., did unlawfully expose or exhibit his sexual organs in a public place or on the private premises of another, or so near thereto as to be seen from such private premises, in a vulgar or indecent manner, or so to expose his person in such place or to go or be naked in such place. (c) On or about November 6, 2002, the Respondent, Daniel G. Hale, Jr., did commit an overt, conspicuous, or public act of a sexual or simulated nature which was likely to be observed by others, to wit: masturbated in the front window of his house, which was observed by another. (d) On or about November 14, 2002, the Respondent, Daniel G. Hale, Jr., did commit an overt, conspicuous, or public act of a sexual or simulated nature which was likely to be observed by others, to wit: masturbated in the front window of his house, which was observed by another. (e) On or about November 27, 2002, the Respondent, Daniel G. Hale, Jr., did commit an overt, conspicuous, or public act of a sexual or simulated nature which was likely to be observed by others, to wit: masturbated in the window of his house, which was observed by another. 3. The actions of the Respondent did violate the provisions of Section 800.03 or any lesser included offenses, Section 943.1395 (6) and/or (7), Florida Statutes, and/or Rule 11B- 27.0011(4)(b) and/or (c), Florida Administrative Code, in that Respondent has failed to maintain the qualifications established in Section 943.13(7), Florida Statutes, which require that a Correctional officer in the State of Florida have good moral character. 4. This Administrative Complaint is issued pursuant to Sections 120.60, and 943.1395(6) and/or (7), Florida Statutes. Any proceedings concerning this Complaint shall be conducted pursuant to Sections 120.569 and 120.57, Florida Statutes, and Rules 1183-27, 28-106, and 28-107, Florida Administrative Code. Mediation is not available under Section 120.573, Florida Statutes. WHEREFORE, it is alleged that the Respondent, Daniel G. Hale, Jr. is guilty of violating Sections 943.1395(6) and/or (7), and/or 943.13(7), Florida Statutes, and/or Rule 11B-27.0011(4) (b) and/or {c), Florida Administrative Code. NOW, THEREFORE, the Florida Criminal Justice Standards and Training Commission hereby complains against Daniel G. Hale, Jr. and alleges that an appropriate penalty, as provided in Section 943.1395(6) and/or (7), Florida Statutes, should be imposed for the reasons set forth above and in accordance with the Election of Rights form (to which is attached an Explanation of Rights form) attached hereto and incorporated herein.
