ADMINISTRATIVE COMPLAINT Petitioner, DEPARTMENT OF BUSINESS AND PROFESSIONAL REGULATION, ("Petitioner"), files this Administrative Complaint before the Board of Cosmetology, against KHUONG BOA NGUYEN (“Respondent"), and says: 1. Petitioner is the state agency charged with regulating the practice of cosmetology pursuant to Section 20.165, Florida Statutes, and Chapters 435 and 477, Florida Statutes, and the tules promulgated thereto. 2. Respondent is, and bas been at all times material hereto, a registered nail specialist in the State of Florida, having been issued licensed number FV 563842. 3. Respondent's address of record is the New River East Unit located at 7819 N.W. 228 St., Raiford, Florida 32026. 4 On June 14, 2002, Respondent was found guilty of selling ecstasy tablets to detectives and was sentenced to five years in prison. An additional 1000 tablets of ecstasy were seized inside the French Nail Salon located at 4300 Kings Hwy, Port Charlotte, Florida 33980, 6. At all times material hereto Respondent was an employee of the French Nail Salon. 7. Respondent’s sale and storage of ecstasy tablets in and from the salon in which he was employed constitutes misconduct. 3. Section 477.028(1)(b), Florida Stanrtes, states in pertinent part that the board shall have the power to revoke or suspend the registration of a specialist and to reprimand, censure, deny subsequent licensure of, or otherwise discipline a specialist upon proof that the holder of a registration is guilty of misconduct in the practice of a specialty. 9. Based on the foregoing, the Respondent violated Section 477.028(1)(b), Florida Statutes, and is therefore subject to disciplinary action by the Board of Cosmetology pursuant to Sections 477.029(1)(h) and (2), Florida Statutes. WHEREFORE, Petitioner respectfully requests the Board of Cosmetology to enter an Order imposing one or more of the following penalties: imposition of an admmistrative fine, revocation or suspension of the Respondent's license, issuance of a reprimand, placement of the Respondent on probation, restriction of Respondent's practice, and/or any other relief which the Board deems appropriate.
