ADMINISTRATIVE COMPLAINT
Petitioner, Jim Home, as Commissioner of Education, files this Administrative Complaint
against JODI SINGER. The Petitioner seeks the appropriate disciplinary sanction of the
Respondent’s educator’s certificate pursuant to Sections 1012.795 and 1012.796, Florida Statutes,
and pursuant to Rule 6B-1.006, Florida Administrative Code, Principles of Professional Conduct for
the Education Profession in Florida, said sanctions specifically set forth in Sections 1012.795(1) and
1012.796(7), Florida Statutes.
The Petitioner alleges:
JURISDICTION
1. The Respondent holds Florida Educator’s Certificate 690430, covering the areas of
English and Gifted, which is valid through June 30, 2004.
2. At all times pertinent hereto, the Respondent was employed as an English Teacher
at North Miami Beach Senior High School, in the Miami-Dade County School District.
MATERIAL ALLEGATIONS
3, On or about September 7, 1999, school administrators held a conference for the
record with the Respondent regarding her absences and tardiness. She was directed to follow schoo!
policy and referred to the district's Employee Assistance Plan. On or about November 29, 1999,
school administrators held a second conference for the record with the Respondent regarding her
absences and tardiness. She was directed to follow policy and referred to the district's Employee
Assistance Plan. On or about April 27, 2000, school administrators held a third conference for the
record with the Respondent regarding her absences, tardiness and insubordination. She was issued

a written directive.
4, On or about June 16, 2000, school administrators held a fourth conference for the
record with the Respondent regarding absences, tardiness, leaving students unsupervised and
bringing her pet bird to school. The Respondent stated during the conference words to the effect that
her cockatoo ("which is a very smart bird") had unlocked her other bird's cage and let the bird out.
The bird then went into the bathroom and chewed on a razor blade. The Respondent stated that "The
bird had a nervous breakdown and attempted to commit suicide." Therefore, the Respondent stated,
she was "concerned for the bird's safety and brought it to school," or werds to that effect. The
Respondent was issued a directive not to bring her bird to school. On or about September 13, 2000,
tne Respondent was suspended by the Miami-Dade County School Board from September 14
through October 25, 2000.
5. On or about January 26, 2001, the Respondent was referred to the district's Employee
Assistance Plan for excessive tardiness. On or about August 2, 2001, school administrators held a
conference for the record with the Respondent to discuss attendance and non-compliance with
cistrict directives and prescriptive activities. The Respondent was issued directives. On or about
September 26, 2001, a conference for the record was held with the Respondent to discuss attendance
and tardiness. She was given written directives.
6. On or about October 25, 2001, the Respondent's principal noticed the Respondent
swaggering and slurring her speech during the course of the school day. The principal called the
Office of Professiona! Standards ("OPS") and requested the Respondent be drug tested. The
Respondent was tested and the results were positive for Cannabis. On or about December 6, 2001,
a conference for the record was held regarding the Respondent's testing positive for Cannabis. She
was directed to participate in.the district's support agency program and net to report to work until
cirected by OPS. On or about January 9, 2002, OPS received notice from the district's support
agency that the Respondent had "dropped out of treatment.” The Principal and Region
Superintendent recommended that the Respondent be terminated from employment. Sheisno longer
employed with the Miami-Dade County School District.
STATUTE VIOLATIONS
COUNT 1: The Respondent is in violation of Section 1012.795(1)(b), Flonda Statutes,
in that Respondent has proved to be incompetent to teach or to perform duties as an employee of the
public school system or to teach in or to operate a private school.
COUNT 2: The Respondent is in violation of Section 1012.795(1){c), Florida Statutes,
in that Respondent has been guilty of gross immorality or an act involving moral turpitude.

COUNT 3: The Respondent is in violation of Section 101 2.795(1)(f), Florida Statutes, in
that Respondent has been found guilty ofpersonal conduct which seriously reduces her effectiveness
as an employee of the schoo! board.
COUNT 4: — The Respondent is in violation of Section 101 2.795(1)(i), Florida Statutes, in
that Respondent has violated the Principles of Professional Conduct for the Education Profession
prescribed by State Board of Education rules.
WHEREFORE, the Petitioner recommends that the Education Practices Commission
impose an appropriate penalty pursuant to the authority provided in Sections 1012.795(1) and
1012.796(7), Florida Statutes, which penalty may include a reprimand, prodation, restriction of the
authorized scope of practice, administrative fine, suspension of the teaching certificate not to exceed
three years, permanent revocation of the teaching certificate, or combination thereof, for the reasons
set forth herein, and in accordance with the Explanation and Election of Rights forms which are
attached hereto and made a part hereof by reference.
