SVEC, Respondent. / ADMINISTRATIVE COMPLAINT Petitioner, DEPARTMENT OF BUSINESS AND PROFESSIONAL REGULATION, (“Petitioner”), files this Administrative Complaint before the Electrical Contractors Licensing Board, against DORRYN R. SVEC, (“Respondent”), and says: 1. Petitioner is the state agency charged with regulating the practice of electrical contracting pursuant to section 20.165, Florida Statutes, and chapters 455 and 489, Part II, Florida Statutes. 2. Respondent is, and has been at all times material hereto, a licensed CERTIFIED ELECTRICAL CONTRACTOR in the State of Florida, having been issued license number EC 1605. 3. Respondent’s address of record is 449 Southwest 126 Terrace, Fort Lauderdale, ’ Florida 33325. Another possible address is 22860 Cascade Palace, Boca Raton, Florida 33428. 4. At all times material hereto, Respondent was the licensed qualifier for DORRYN R. SVEC; INC. and was responsible in that capacity for supervision of all operations of this business organization, for all work at all sites, and for financial matters for both the organization . In general and each specific job (see section 489.522, Florida Statutes). 5. Robert Funicello entered in a contract with Boca Tecca Condominium Association dated January 14, 2003, io perform electrical work at 5500 Northwest Avenue, Boca Raton, Florida. 6. The pertinent electrical work included repairing shorted out main feeds from the electric meter room to units 422, 424, and 321, removing existing #1 through copper conductors through underground conduits, repairing conduits, and pulling copper conductors #1 through to the respective units, emergency repairs to unit 701 electrical panel, installing temporary feed from main disconnect in meter room to damaged area, and check all electrical operations. 7, Robert Funicello received a check for $3,848.00 dated March 12, 2003, for the pertinent electrical work done at 5500 Northwest Avenue, Boca Raton, Florida. 8. Respondent applied for an electrical permit for the pertinent electrical work by submitting an application dated April 28, 2003, to the Boca Raton Building Inspection Division. 9. On April 29, 2003, Respondent was issued an electrical permit for the pertinent electrical work to be performed at 5500 Northwest Avenue, Boca Raton, Florida. 10. Robert Funicello performed electrical work at 5500 Northwest Avenue, Boca Raton, Florida, pertinent to the aforementioned contract. ) ll. For all times material hereto, Robert Funicello has been unlicensed in the State of Florida as an electrical contractor. 12. Section 489.533(1)(), Florida Statutes, states, “[t]he following acts shall constitute grounds for disciplinary actions as provided in subsection (2): [pJerforming any act which assists a person or entity in engaging in the prohibited uncertified and unregistered practice of contracting, if the certificateholder or registrant knows or has reasonable grounds to know that the person or entity was uncertified and unregistered.” 13. Based upon the foregoing, the Respondent has violated section 489.533(1)q), Florida Statutes. WHEREFORE, Petitioner respectfully requests the Electrical Contractors’ Licensing Board enter an Order imposing one or more of the following penalties: place on probation, reprimand the licensee, revoke, suspend, deny the issuance ‘or renewal of the certificate or registration, fequire correction, impose an administrative fine not to exceed $5,000 per violation, require continuing education, assess costs associated with investigation and prosecution, impose any or all penalties delineated veithin chapters 455 and 489 Part I, Florida Statutes, and/or any © other relief that the Board is authorized to impose pursuant to chapters 489 and 455, Florida Statutes, and/or the rules promulgated thereunder. = wD Signed this da (5 2003.
