HARRELL, The Petitioner seeks the disciplinary Sanction of the Respondent's educator's certificate pursuant Florida, said Sanctions Specifically set forth in Sections 1012.795(1 Florida Statutes, The Petitioner alleges: JURISDICTION SIC TION 1, The Respondent holds Florida educator's Certificate 7} 1488, covering the area of Mathematics Which is valid through June 30, 2007, MATERIAL ALLEGATIONS et ALLEGATIONS 3, On or about November 26, 2001, the Respondent's professiona] performance was observed and evaluated as a Part of his annual evaluation. Based upon this observation, the Respondent Was found to be unsatisfactory in five areas: learning Toutines, managing engagement in learning, knowledge of content and pedagogy, Monitoring engagement and/or involvement in learning and informal assessment, VES MICAH D. On or about February 27, 2002, the Respondent’s professional performance was observed and evaluated as a part of his annual evaluation, Based upon this observation, the Respondent was found to be unsatisfactory in six areas: initial motivation to learn, teaching methods and learning tasks, knowledge of content and pedagogy, higher order cognition, questioning strategies and problem solving and creative thinking. 6. On March 5, 2002, the Respondent’s Professional Improvement Plan was updated. 7 On or about March 26, 2002, the Respondent’s professional performance was observed and evaluated as a part of his annual evaluation. Based upon this observation, the Respondent was found to be unsatisfactory in three areas: Clarification of content/learning tasks, questioning Strategies and feedback. 8. Despite ample time and assistance provided by the school district for remediation and improvement, the Respondent’s professional performance remained unsatisfactory, and as a result he was terminated from his position of employment with the school district. STATUTE VIOLATION Seti VIOLATION COUNT 1. The allegations of misconduct set forth herein are in violation of Section 1012.795(1)(b), Florida Statutes, in that Respondent has Proved. to be incompetent to teach or to perform duties as an employee of the public school system or to teach in or to operate ‘a private school. WHEREFORE, the Petitioner recommends that the Education Practices Commission impose an appropriate penalty Pursuant to the authority provided in Sections MICAH D.
