FINAL ORDER THIS CAUSE comes before the AGENCY FOR HEALTH CARE ADMINISTRATION (the "Agency") conceming Certificate of Need ("CON") Application No. 9895, which was filed by MOUNT SINAI MEDICAL CENTER OF FLORIDA, INC. (hereinafter "Mount Sinai") on February 13, 2006, requesting a CON for a new 116 private bed acute care satellite hospital, which application was denied. Thereafter, Mount Sinai timely filed at the Division of Administrative Hearings ("DOAH") a Petition for Administrative Hearing with respect to the denial. On July 25, 2006, Mount Sinai filed its voluntary dismissal of the DOAH case. On July 26, 2006, an Order Closing File was issued by DOAH as a result of the voluntary dismissal. It is therefore ORDERED and ADJUDGED: A The voluntary dismissal by Mount Sinai and the Order Closing File by DOAH are hereby acknowledged and accepted. 2.
