ADMINISTRATIVE COMPLAINT
State of Florida, Department of Business and Professional Regulation, Division of Real
Estate (“Petitioner”) files this Administrative Complaint against Candace Lynn Savitz
(“Respondent”) and alleges:
ESSENTIAL ALLEGATIONS OF MATERIAL FACT
1. Petitioner is a state government licensing and regulatory agency charged with the
responsibility and duty to prosecute Administrative Complaints pursuant to the laws of the State of
Florida, in particular Section 20.165 and Chapters 120, 455 and 475, of the Florida Statutes and the
rules promulgated pursuant thereto.
2. Respondent is and was at all times material hereto a licensed Florida real estate broker,
issued license number 675238 in accordance with Chapter 475 of the Florida Statutes.
3. The last license issued was as a broker at Real Estate Direct Brevard, Inc., 457 Montreal
Avenue, Melbourne, Florida 32935.

4. On or about May 14, 2002 Respondent registered with the Florida Department of State-
Division of Corporation Hollywood Stars Realty Inc. (Hollywood) A copy of the registration is
attached hereto and incorporated herein as Exhibit 1.
5. Respondent was the registered agent for Hollywood.
6. Respondent was the only director named for Hollywood.
7. Respondent was the only officer named for Hollywood.
8. On or about March 4, 2003 Respondent opened checking account 110004983 with Home
Federal Bank of Hollywood in the name of Hollywood Star Realty Inc., with an initial $100.00
deposit. A copy of the bank statement is attached hereto and incorporated herein as Exhibit 2.
9. On or about March 4, 2003 Respondent received $4000.00 escrow deposit from Stephen
Shinkman (Buyer) for the purchase of a property owned by Robamar Properties and located at 1850
Lincoln St. Hollywood FL 33020. (Subject Property) A copy of the contract is attached hereto and
incorporated herein as Exhibit 3.
10. On or about March 4. 2003 Respondent received an escrow deposit for $6000.00 from
the Buyer for the Subject Property. A copy of the contracts are attached hereto and incorporated
herein as Exhibit 4 and 5,
11. Atall times material, Respondent deposited the $4000.00 and $6000.00 escrow deposit
to the account 110004983.
12. As per contract terms, Respondent received an additional $5000.00 escrow deposit from
Buyer for the purchase of the Subject Property.

13. Respondent knew or should have known that Hollywood Star Realty, Inc., was not
licensed as a real estate corporation in the state of Florida. A copy of the licensing is attached hereto
and incorporated herein as Exhibit 6.
14. Respondent failed to maintain escrow fund in an escrow account until disbursement was
properly authorized.
15. On or about May 14, 2003 Respondent received notice from Buyer placing a demand on
the escrow funds.
16. On or about May 16, 2003 Respondent received notice from Seller placing a demand on
the escrow funds.
17. On or about July 7, 2003 Respondent gave notice to the Florida Real Estate Commission
(Commission) to having received conflicting demand for escrow funds. A copy of the notice is
attached hereto and incorporated herein as Exhibit 7.
18. Respondent failed to notify the Commission within 30 days to having implemented an
escape procedure or requesting an escrow disbursement order as required by Florida Statutes, when
conflicting demands are received for escrow funds. A copy of the letter is attached hereto and
incorporated herein as Exhibit 8.
19. Respondent failed to provide all deposit slips and statement of account for the escrow
account to Petitioner’s representative.
20. Respondent failed to reconcile the escrow account on a monthly basis.
COUNT I
Based upon the foregoing, Respondent is guilty of failure to provide written notification to
the Commission within fifteen business days of the last party’s demand and failure to institute one of

the settlement procedures as set forth in Section 475.25(1)(d)1., Florida Statutes, within thirty
business days after the last demand in violation of Rule 61J2-10.032(1)(a) of the Florida
Administrative Code and, therefore, in violation of Section 475.25(1)(e), Florida Statutes.
COUNT II
Based upon the foregoing, Respondent is guilty of failure to preserve and make available to
the Petitioner, all books, records, and supporting documents and failed to keep an accurate account of
all trust fund transactions in violation of Rule 6152-14.012(1) of the Florida Administrative Code
and, therefore, in violation of Section 475.25(1)(e), the Florida Statutes.
COUNT IT
Based upon the foregoing, Respondent is guilty of failure to prepare the required written
monthly escrow statement-reconciliations in violation of Rule 61J2-14.012(2) and (3) of the Florida
Administrative Code and is, therefore, in violation of Section 475.25(1)(e), Florida Statutes.
COUNT IV
Based upon the foregoing, Respondent is guilty of failure to immediately deposit trust funds in
violation of Rule 61J2-14.010 of the Florida Administrative Code and, therefore, in violation of Section
475.25(1)(e), Florida Statutes.
COUNT V
Based upon the foregoing, Respondent is guilty of aiding, assisting, procuring, employing, or
advising any unlicensed person or entity to practice a profession contrary to Chapter 455, 475 or the
rules of the Petitioner in violation of Section 455.227(1)(j), Florida Statutes.

COUNT VI
Based upon the foregoing, Respondent is guilty of failure to maintain trust funds in the real
estate brokerage escrow bank account or some other proper depository until disbursement thereof was
properly authorized in violation of Section 475.25(1)(k), Florida Statutes.
WHEREFORE, Petitioner respectfully requests the Florida Real Estate Commission, or the
Department of Business and Professional Regulation, as may be appropriate, to issue a Final Order as
final agency action finding the Respondent(s) guilty as charged. The penalties which may be
imposed for violation(s) of Chapter 475 of the Florida Statutes, depending upon the severity of the
offense(s), include: revocation of the license or registration or permit; suspension of the license,
registration or permit for a period not to exceed ten (10) years, imposition of an administrative fine
of up to $1,000 for each count or offense; imposition of investigative costs; issuance of a reprimand;
imposition of probation subject to terms including, but not limited to, requiring the licensee,
registrant or permitee to complete and pass additional real estate education courses; publication; or
any combination of the foregoing which may apply. See Section 475.25(1), Florida Statutes and
Florida Administrative Code Rule 61J2-24.001. The penalties which may be imposed for
violation(s) of Chapter 455 of the Florida Statutes, depending upon the severity of the offense(s),
include: revocation of the license, registration, or permit; suspension of the license, registration, or
permit for a period not to exceed ten (10) years; imposition of an administrative fine of up to $5,000

testimony, to call and cross-examine witnesses, and to have subpoena and subpoena duces
tecum issued on your behalf if a formal hearing is requested.

RE: Notice of Escrow Dispute
Dear Broker: _
We recently received notice of an escrow dispute from your office in
accordance with the requirements of Section 475.25(1 \(d)1, Florida Statutes,
and Rule 61J2-10.032(1)(b), Florida Administrative Code.
Unfortunately, our records indicate that more than 30 days have elapsed
since the date of your notice, and we have received no additional advice
from you as to whether the dispute has been settled by the parties or will be
the subject of an EDO request, mediation, arbitration, or litigation.
Please note that Section 475.25(1)(d)1, Florida Statutes, imposes a duty on
the licensee as follows:
if conflicting demands have been made upon the licensee for the
escrowed property, which property she or he still maintains in her
or his escrow or trust account, the licensee shall promptly notlfy
the commission of such doubts or conflicting demands and shall
promptly: :
a. Request that the commission issue an escrow disbursement
order determining who is entitled to the escrowed property;
b. With the consent of all parties, submit the matter to arbitration;
c. By interpieader or otherwise, seek adjudication of the matter by
@ court; or
d, With the written consent of all parties, submit the matter to
mediation. The department may conduct mediation or may
contract with public or private entities for mediation services.
However, the mediation process must be successfully completed
within 90 days following the last demand or the licensee shall
promptly employ one of the other escape procedures contained In
this section. Payment for mediation will be as agreed to in writing
by the parties. The department may adopt rules to implement this
section.
Please advise this office, in writing, within. ten (10) days from the date of this
letter, of the method by which you have chosen fo resolve the pending
escrow dispute.
