Petitioner is charged with providing admlnistrative, investigdtive, and prosecutorial services to the Board of Professional Engineers pursuant to ion 471.038, Florida Statutes (2003). The Board of Professional Engineers is tharged with regulating the practice of engineering pursuant to Chapter 455, Florida stitutes. 2. Respondent Is a licensed professional engineer in the oa Florida, having been issued license number PE 42702. Respondent's last known i ress is 8641-B Boca Glades Bivd., Boca Raton, Florida 33434. 3. SCA Engineering and Consulting provided geotechnical soil } the signature of Respondent, printed from a computer, and the em - Respondent. | 5. Between March and August 2004, SCA Engineering and Corbutting employees sent out hundreds of reports under the Seal of Respondent th had not been prepared or produced by him or under his responsible charge. 6. At all times retevant to this administrative complaint, Respot{dent’s address was more than 200 miles from the office from which SCA’s reports were issued. fl 7. Respondent facilitated use of his seal on the SCA reports by embossing seal with his name and license number at the office of SCA. if 8. Respondent knew or should have known that SCA used his deal on ‘ i hundreds of reports that Respondent did not prepare, produce or review. i. 9. Rule 61G15-19.001(6)(j), Florida Administrative Code, Provides that "misconduct in the practice of engineering includes affixing his seal and/orsignature to plans, specifications, drawings or other documents required to be sealed pursuant to 471.025(1), Florida statutes, when such document has not been personally prepared by : : - the engineer or prepared under his responsible supervision, direction and ontrol. ada £ ~ FEMC v.
