Winn, as Commissioner of Education, files this Administrative Complaint against KATHLEEN K. SINASAC. ‘The Petitioner seeks the appropriate disciplinary sanction of the Respondent's educator’s certificate pursuant to Sections 1012.795 and 1012.796, Florida Statute s, and pursuant to Rule 6B-1.006, Florida Administrative Code, Principles of Professional Conduct for the Education Profession in Florida, suid sanctions specifically set forth in Sections 1012.7 D5(L) and 1012.796(7), Florida Statutes. The Petitioner alleges: JURISDICTION | The Respondent holds Florida Educator’s Certificate 716650, covering the arcas of Elementary Education and Primary Education, which was valid through June 30, 2005. 2, Al all tunes pertinent hercto, the Respondent was employed as a Kindergarten Teacher at Hope Rural Catholic School K-12 i the Martin County School Districl. MATERIAL ALLEGATIONS 3. On or about November 22, 2002, Respondent pled and the court adjudicated her guilty of: Driving Under the Influence-Manslaughter; Driving Under the Influence—Great Bodily Harm; und Driving Under the Influence. SINASAC Administrative Complaint Page 2 of 2 STATUTE VIOLATIONS COUNT I: — The Respondent is in violation of Section 101 2.795(1)(c), Florida Statutes, Respondent has been guilty of gross immorality or an act invelving moral turpitude. COUNT 2: ‘The Respondent is in viotation of Section 1012.795(1)(c), Florida Statutes, Respondent has been convicted of a misdemeanor, felony, or other criminal charge, other than a minor traffic violation. COUNT3: — The Respondent is in violation of Section 1U12.795(1)(1), Florida Statutes, in that Respondent has heen found guilly of personal conduct which seriously reduces her effectiveness as an eniployee of the school board. COUNT4: — The Respondentis in violation of Seetion | 012.795(2), Florida Statutes, which provides that the plea. of guilty in any court or the decision of guilty by any court is prima lacie proaf of grounds [or the revocation of the certificate.
