Ol 3} a e PL / ADMINISTRATIVE COMPLAINT The Criminal Justice Standards and Training Commission, hereinafter referred to as the Commission, files this Administrative Complaint ‘against the Respondent, David B. Baker. The Commission seeks to impose disciplinary action upon the referenced individual based on tha following allegations: 1. Respondent was certified by the Criminal Justice Standards and Training Commission on February 28, 2005, and was issued Law. Enforcement Certificate Number 246712. 2. On ox about October 9, 2005, the Respondent, David EB. Baker, did unlawfully and intentionally commit an assault upon Craig Saucier and/or Donald Saucier by threatening by word or act to do violence to said person, coupled with an apparent ability to do so, and by doing an’ act which created a well-founded fear in said Craig Saucier and/or Donald Saucier that said violence was imminent, by threatening and firing shots with a deadly weapon, to-wit: a .45 caliber revolver. 67/86/2866 15:29 8584187691 FDLE OGC PAGE @4/87 SUL DO AWD Loe 87/66/2086 15:29 8564107691 FDLE OGC PAGE 685/07 3. The actions of the Respondent did violate the provisions of Section 784.021(1) (a), Florida Statutes or any lesser included offenses, Section 943.1395(6) and/or (7), Florida Statutes, and/or Rule 115- 27.0011 (4)a, Florida Administrative Code, in that Respondent has failed to maintain the qualificationa established in Sectdon 943.13(7), Florida Statutes, which require that a Law Enforcement Officer in the. State of Florida have good moral character. 74, This Administrative Complaint is issued pursuant to Sections 120.60, and 943.1395(6) and/or (7), Florida Statutes. Any proceedings concerning this Complaint shall be conducted pursuant to Sections 120.569 and 120.57, Florida Statutes, and Rules 11B-27, °'26-106, and 26-107, Florida Administrative Code. Mediation is not available under Section 120.573 Florida Statutes. ‘ WHEREFORE, it is alleged that the Respondent, David BE. Baker is guilty of violating Sections 943.1395 (6) ‘and/or (7), and/or 943.13(7), Florida Statutes, and/or Rule 118-27.0011(4)a, Florida Administrative Cade, NOW, THEREFORE, the Florida Criminal Justice Standards and Training Commission hereby complains against David E. Baker and alleges that an appropriate penalty, as provided in Section 943.1395(6) and/or (7), Florida Statutes, should be imposed for the reasons set forth above and in accordance with the Election of Rights form (to which is attached an Explanation of Rights form) attached hereto and incorporated herein.
