The Commission seeks to impose disciplinary action upon the referenced individual based on the following allegations: 1. Respondent was certified by the Criminal Justice Standards and Training . Commission ‘on August 18, 2000,, and was issued Corrections Certificate Number 192967 and on June 25, 2001 and was issued Law Enforcment Certificat Number 197613. Bao {a) On or between June 21, 2003 and June 21, 2004, the Respondent, James Bott, did unlawfully and intentionally teuch, handle, fondle, or assault A.M., a person twelve years of age or older, but less than sixteen, in 4 lewd, lascivious, or indecent manner, by touching her breasts, genitals, genital area, or buttocks, or the clothing covering them and/or did force or entice A.M. to so touch him. M. perform oral sex on his penis, and/or by rubbing his penis on the vagina of A.M., thereby creating a union with his _ penis and her vagina. 3B. The actions of the Respondent did violate the provisions of Section 600.04 (3) (a) (2) (2) and/or 800.04(4) (a) Florida Statutes, or any lesser included offenses, Section 943.1395(6) and/or (7), Florida Statutes, and/or pule 118-27.0011(4)a, Florida Administrative Code, in that Respondent has failed to maintain the qualifications established in Section’ 943.13(7), Florida Statutes, which require that a Correctional and/or Law Enforcement Officer in the State of Florida have good moral character. 4. This Administrative Complaint is ‘issued pursuant to Sections 120.60, amd 943.1395(6) and/or (7), Florida Statutes. Any proceedings concerning this Complaint shall be conducted pursuant to Sections 120.569 and 120.57, Florida Statutes, and Rules 11B-27, 28-106, and 28-107, Florida Administrative Coda. Mediation is mot available under Section 120.573, Florida Statutes.
