Petitioner, John L. Winn, as Commissioner of Education, files this Administrative
Complaint against ZINA R. STEINSIEK. The Petitioner seeks the appropriate disciplinary
sanction of the Respondent's educator's certificate pursuant to Sections 1012.795 and
1012.796, Florida Statutes, and pursuant to Rule 6B-1006, Florida Administrative Code,
Principles of Professional Conduct for the Education Profession in Florida, said sanctions
specifically set forth in Sections 1012.795(1) and 1012.796(7), Florida Statutes,
The Petitioner alleges:
JURISDICTION .
1. The Respondent holds Florida educator's certificate 470432, covering the
areas of Elementary Education and Mentally Handicapped which is valid through June 30,
2009.
2. At all times pertinent hereto, the Respondent was employed as a Reading
Teacher at Blackwater STOP Camp and Munson Elementary School in the Santa Rosa
County School District.
MATERIAL ALLEGATIONS
3. On or about April 22, 2004, the Respondent directed a student to stop
drawing in his notebook. When he refused, the Respondent told the student that she would
“nail you to the wall” if he continued to disobey her. She then grabbed the student's
notebook, walked to the door and threw the notebook down the hall.

4, On or about March 10, 2004, the Respondent told her students that she was
going to make life miserable for them and was going to make a chain-gang out of them, She
also made statements to her students that they were going to die in concentration camps.
5. ‘On or about April 12, 2004, the Respondent told her students that she did not
care if they all left the classroom, went outside and rotted in the sun.
6. On or about May 11, 2004, the Respondent stated that if she lost her job she
would have her husband slit her principal's throat. She stated that her husband had slit
throats in Vietnam and it would not be a problem to do it again. As a result of these threats
the Respondent was not allowed back on school grounds, and the district found it necessary
to transfer her,
7. In the Spring of 2004 the Respondent stated as she left her job site that she
would slit the tires of everyone that worked at that location,
8. In February 2005 the Respondent engaged in unprofessional conduct when
she went to the home of a co-worker to confront her over an incident which occurred at
school early that morning. The Respondent berated her co-worker with profanity and
vulgarity in such a manner as to disturb the co-worker's family and surrounding neighbors,
The Respondent was later advised that she was not welcome on her co-worker’s property,
and that if she returned, trespass charges would be filed. Three weeks later the Respondent
returned to the property. Trespass charges were subsequently filed against her as a result,
STATUTE VIOLATIONS
COUNT 1. The allegations of misconduct set forth herein are in violation of
Section 1012.795(1)(c), Florida Statutes, in that Respondent has been guilty of gross
immorality or an act involving moral turpitude,
COUNT 2. The allegations of misconduct set forth herein are in violation of
Section 1012.795(1)(f), Florida Statutes, in that Respondent, upon investigation, has been
found guilty of personal conduct which seriously reduces her effectiveness as an employee
of the school board.
COUNT3. The allegations of misconduct set forth herein are in violation of
Section 1012.795(1)(i), Florida Statutes, in that Respondent has violated the Principles of
Professional Conduct for the Education Profession in Florida prescribed by State Board of
Education.

RULE VIOLATIONS
COUNT 4. The allegations of misconduct set forth herein are in violation of
Rule 6B-1.006(3)(a), Florida Administrative Code, in that Respondent has failed to make
reasonable effort to protect the student from conditions harmful to learning and/or to the
student’s mental health and/or physical health and/or safety.
COUNT 5. The allegations of misconduct set forth herein are in violation of Rule
6B-1.006(3)(e), Florida Administrative Code, in that Respondent has intentionally exposed a
student to unnecessary embarrassment or disparagement.
COUNT 6. The allegations of misconduct set forth herein are in violation of Rule
6B-1.006(5)(d), Florida Administrative Code, in that Respondent has engaged in harassment
or discriminatory conduct which unreasonably interfered with an individual's performance of
professional or work responsibilities or with the orderly processes of education or which
created a hostile, intimidating, abusive, offensive, or oppressive environment; and further,
failed to make reasonable effort to assure that each individual was protected from such
harassment or discrimination.
COUNT 7. The Respondent is in violation of Rule 6B.1006(5)(0), Florida
Administrative Code, in that Respondent sought reprisal against any individual who has
reported an allegation of a violation of the Florida School Code or State Board of
Education Rules as defined in Section 1012.795(1), Florida Statutes.

Explanation of Rights and Election of Rights forms attached to and made a part of this
educator’s certificate for a period of time up to 10 years or permanently; or barring the
Respondent from reapplying for an educator’s certificate for a period of time up to 10
years or permanently,
