RESPONDENT. ot = ADMINISTRATIVE CO = & COMES NOW, Petitioner, Department of Health, by and throfigh its undersigned counsel, and files this Administrative Compfaint before the Board of Nursing against Respondent, Retta Lynn Pringle, R.N., and in:support thereof alleges: 1. Petitioner is the state department charged with regulating the practice of nursing pursuant to Section 20.43, Florida Statutes; Chapter 456, Florida Statutes; and Chapter 464, Florida Statutes. 2. Atall times material-to this Complaint, Respondent was a licensed registered. nurse (R.N.) within the state of Florida, having been issued license number RN 1851822. Depertment of Health v. Respondent’s address of record is 564 East Drive, Miami, Florida 33166. . 4. At all times material to this Complaint, Respondent was employed by Hospice Care of Southeast Florida, Inc. in Ft. Lauderdale, Florida 33316. , 5. On or about June 6, 2005, Respondent submitted to an employer initiated drug screen. 6. The drug screen was positive for cannabis. 7. Cannabis is listed in Chapter 893, Florida Statutes, as a Schedule I controlled substance. A Schedule I substance has a high potential for abuse and has no currently accepted medical use in treatment in the United States and in its use. under medical supervision does not meet accepted safety standards. 8. Section 464,018(1)(n), Florida Statutes (2004), provides that failing to meet minimal standards of acceptable and prevailing nursing practice constitutes grounds for discipline. 9. Rule 64B9-8.005(2)(k), Florida Administrative Code, states that failing to meet or departing from minimal standards of acceptable and prevailing nursing practice shall include testing Department of Health v. Respondent tested positive for cannabis, a controlled substance under Chapter 893, Florida Statutes, following an employer-ordered drug screen and did not have a lawful prescription "or legitimate medical reason for using the drug. 1i. Based on the foregoing, Respondent has violated Section 464.018(1)(n), Florida Statutes (2004), by failing to meet minimal standards of acceptable and prevailing nursing practice as defined by Rule 64B9-8.005(2)(k), Florida Administrative Code. NOTICE REGARDING ASSESSMENT OF COSTS Respondent is placed on notice that Petitioner has incurred costs related to the investigation and prosecution of this matter. Pursuant to Section 456.072(4), Florida Statutes, the Board shall assess costs related to the investigation and prosecution of a disciplinary matter, which may include attorney hours and costs, on the Respondent in addition to any other discipline imposed.
