ADMINISTRATIVE COMPLAINT Petitioner, DEPARTMENT OF BUSINESS AND PROFESSIONAL REGULATION (“Petitioner”) files this Administrative Complaint against AMY MASON (“Respondent”), and alleges: 1. Petitioner is the state agency charged with regulating the provision of real estate services, pursuant to Section 20.165, Florida Statutes., and Chapters 455 and 475, Florida Statutes. 2. The Department of Business and Professional Regulation has jurisdiction over the unlicensed provision of real estate services pursuant to Section 455.228, Florida Statutes. 3. Chapter 120, Florida Statutes, entitles the Respondent to elect a hearing regarding the allegations contained hetein. Rule 28-106.111, Florida Administrative Code, provides in part that if a Respondent fails to request a hearing within twenty-one (21) days of receipt of an agency pleading, the Respondent shall have waived his right to request a hearing on the facts alleged, Sep 27 2006 16:52 aq/27/2886 16:48 8589219186 DEPR PAGE 83/85 4. Respondent’s address of record is 772 Marywood Drive, Panama City, Florida 32405. 5. On or about February 28, 2005, the Respondent entered into commissioned sales employment with Acquire Real Estate, Inc. ("Acquire") as a real estate sales associate in the State of Florida. 6. On or about June 2005, the Respondent was employed by Comerstone Realty Group ("Cornerstone") as a Real Estate Sales Associate in the State of Florida. 7. In procuring the aforementioned employment, the Respondent submitted to Acquire and Cornerstone a forged real estate license. &. In procuring the aforementioned employment, the Respondent submitted to Acquire and Cornerstone forged letters from the Department 's License Maintenance Department. 9. Section 475.42, Florida Stanutes, prohibits operating as a real estate broker or salesperson as defined in Section 475.01, Florida Statutes, without a license issued pursuant to Chapter 475, Florida Statutes. 10. Section 475.626, Florida Statutes, prohibits operating or attempting to Operate as an appraiser as defined in Section 475.611, Florida Statutes, without a license issued pursuant to Chapter 475, Florida Statutes. 11. Based upon the foregoing, the Respondent has violated Subsection 475.42, Florida Statutes, by operating as a real estate broker or salesperson in the State of Florida.
