U | v d Respondent, ADMINISTRATIVE COMPLAINT Petitioner, James E. McCalister, Sr., as Superintendent of the School District of Bay County, Florida (the Superintendent”), files this Administrative Complaint against Alice Petitti, Respondent. The Petitioner seeks the appropriate disciplinary sanctions against the Respondent pursuant to Chapter 120, Section 1012.33, Florida Statutes, and the policies of the Bay County School Board. The Petitioner alleges as follows: 1. The Respondent is employed as a Food Services Worker in the Food Services Department at Arnold High School in the School District of Bay County. 2. The Respondent is classified as a continuous employee under Article 10.4 of the Master Contract between the Bay County School Board and the Bay Educational Support Personnel Organization (Collective Bargaining Agreement). 3. The Respondent was an adequate worker, but had a history of being disruptive in the work area. 4. On September 1, 2006, Respondent was involved in a incident with a student that ended with the Respondent telling a student, “You can take that bird and shove it up your ass.” Respondent had been asked by the cafeteria manager to watch the students and keep them from breaking in line. Respondent then asked Matt Pitts, Administrative Assistant at that time, to watch the students because she noticed some girls walk in from the side door of the cafeteria, and they broke in line. When Respondent confronted the students all parties began raising their voices. As Matt Pitts approached them, the girls walked away. One of the students “shot [Respondent] a bird.” Respondent admits that she “just went off.” Respondent started toward the student but was stopped when Matt Pitts grabbed her by the arm. 5. On September 18, 2006 the Respondent was given an informal hearing with the Superintendent to discuss the circumstances surrounding the incident. 6. As a direct result of this incident, the Respondent was suspended with pay by the Superintendent until the investigation was completed. 7. On September 27, 2006, the Superintendent recommended to the Bay County School Board that the Respondent be suspended without pay and move toward termination of her employment. 8. The Bay County School Board voted to suspend the Respondent without pay and to proceed to terminate her employment. 9. The allegations set forth herein establish good and sufficient reasons to terminate the employment of the Respondent under her contract with the Bay County School Board, Article 10.5 of the Collective Bargaining Agreement, Florida Statutes, and the policies of the Bay County School Board. -2- WHEREFORE, Petitioner recommends that the School Board of the School District of Bay County, Florida, uphold the suspension of the Respondent and dismiss her as an employee of said School District for the reasons set forth above. ty DATED nig LO of November, 2006.
