AND PROFESSIONAL REGULATION (“Department”), files this Administrative Complaint before the Board of Cosmetolo; Ey, against TATYANA D. FONSECA (“Responden ”), and says: ane Petitioner is the state agency charged with regulating the practice of cosmetology pursuant to Section 20,165, Florida Statutes, and Chapters 455 and 477, Florida Statutes, and the rules promulgated thereto, 2. Respondent’s address of record is 10810 sw 148" Court, Miami, Florida 33196. . 3, At all times material hereto, Respondent was licensed in the State of Florida as a cosmetologist, having been issued license CL 0236298. 4.. At all times material hereto, Respondent was the owner of EXPERTS BEAUTY NAILS (Unlicensed), located at 9726 Bird Road, Miami, Florida 33165. 5. On or about May 17, 2006, ‘Petitioner's inspector, Beatriz Caldera, conducted an inspection of EXPERTS BEAUTY NAILS, . 6. During. the inspection, Department’s inspector observed that EXPERTS BEAUTY NAILS was open and operating, 7.° During the inspection, a search of Department records revealed’ that EXPERTS BEAUTY NAILS was not a licensed cosmetology establishment in the State. of Florida. 8. Section 477. 0265(1)0) Florida Statutes, states in n pertinent part t that it is unlawful for any person to ‘ To}wn, operate, maintain, open, establish, conduct, or have charge of, either alone or with another person Or persons, a cosmetology salon or specialty salon: which is not licensed.” ) #8. Based on the foregoing, Respondent violated Section 477. 029(1)(), Florida Statutes, by operating an unlicensed cosmetology salon, and i is thereby subj ect to discipline pursuant to Sections 477.029(1)(h) and @), Florida Statutes. WHEREFORE, Petitioner respecthlly requests the Board of Cosmetology enter a Final Order imposing one or more of the following penalties: imposition of an administrative fine, revocation or suspension of the Respondent's license, issuance of a reprimand, placement of the Respondent on probation, restriction of Respondent's practice, and or any other relief which the Board deems appropriate.
